PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 10 October 1988, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—pattern of misconduct, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of her rights, consulted with legal counsel, was advised of the impact of the discharge action, waived personal appearance before an administrative separation board, and did not to submit a statement in her own behalf. The separation authority directed that the applicant be discharged with a GD.

         b. On 10 November 1988, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 1 year, 5 months, and 22 days of her current enlistment, and a total of 11 years, 8 months and 19 days of active military service.

         c. The applicant’s record shows that she completed a total of almost
12 years of service; attained the rank of staff sergeant/E-6; completed an overseas tour in Germany; and had earned three Good Conduct Medals, the Meritorious Service Medal, and the Army Achievement Medal. There is no record of court-martial or nonjudicial punishment contained in the applicant’s record and no indication that she was ever reduced in rank while on active duty. There is a history of alcohol related problems which were the basis for the applicant’s separation. The unit commander cited the following incidents as the basis for taking separation action: a 29 December 1987 civil conviction for DUI; a 12 August 1988 incident of the applicant leaving the scene of an accident; and a 25 August 1988 DUI charge for which she was pending civil court action at the time separation action was initiated. The applicant waived her right to an administrative separation board and she was separated with a GD.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

(3) The issue is accepted. There was a full consideration of all service including the infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board determined that the characterization of service was inequitable because the length and quality of the applicant’s service mitigated the discrediting entries in the service record. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to fully honorable. The Board determined that the reason for discharge was proper and equitable and voted not to change it.
