PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 27 June 1989, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with a general, under honorable conditions (GD) discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, unconditionally waived having his case heard by an administrative separation board, and did not submit a statement on his behalf. The unit commander subsequently recommended separation from the Army. The intermediate commander reviewed the proposed discharge action and recommended approval with a GD. On 2 October 1989, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 26 October 1989, the applicant was discharged with a general, under honorable conditions discharge, under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance. At the time of discharge, the applicant had 3 years, 4 months, and 6 days on his current enlistment and a total of 7 years, 4 months, and 6 days time in service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

         a. Propriety:    The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above:

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The record does not support the applicant’s contention, and no evidence to support it has been submitted by the applicant, that his REFRAD was changed without proper approval. The evidence of record shows that on 1 July 1988, the applicant was reassigned by DA, US Army Reserve Personnel Center permanent change of station (PCS) Order #R-07-003277 with an active duty commitment of 3 years, effective 15 August 1988. This extended his REFRAD to 14 August 1991. The applicant's Leave and Earnings Statement (LES) further confirms this date as his ETS date. Finally, the record contains a promotion order dated 15 November 1988 which establishes a 1-year AGR obligation from the effective date of the applicant's promotion to E6 (881201). The Board found no evidence of arbitrary or capricious actions by the command. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process.

The record reflects the unit commander denied the applicant’s request for early release from his active guard reserve (AGR) tour because he had initiated administrative actions against the applicant. The Board concluded that the applicant's discharge was appropriate because the quality of service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. By his misconduct and poor duty performance, the applicant diminished the quality of service below that meriting a fully honorable discharge. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that the applicant’s service mitigated the misconduct or poor duty performance. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
