PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 8 April 1993, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 11, AR 635-200, sociological problems, with an entry level separation-uncharacterized discharge. She was advised of her rights. The applicant acknowledged notification, consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement on her behalf. The unit commander subsequently recommended approval of the discharge action and forwarded it through command channels to the separation authority. On
9 April 1993, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with an entry level separation-uncharacterized discharge.

         b. On 16 April 1993, the applicant was discharged with an uncharacterized discharge, under the provisions of Chapter 11, AR 635-200, by reason of entry level status performance and conduct. He was credited with 4 months, and 13 days active service on the enlistment under review. The DD Form 214 (Certificate of Release or Discharge From Active Duty) issued to the applicant at the time of discharge, erroneously shows in block #28 (Narrative Reason For Separation) "Entry Level Status Performance and Conduct." Regulations, then in effect, indicate the appropriate entry in block #28 should be "Entry Level Status."

         c. The unit commander indicated that the specific reasons for his initiation of the applicant's discharge was that she displayed a pattern of misconduct that was inconsistent with the military lifestyle and she failed to respond positively to any of the counseling or nonjudicial punishments.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 11, of this regulation, in effect at the time, provided, for the separation of personnel due to unsatisfactory performance, conduct, or both, while in an entry level status. This provision of regulation applied to individuals who had demonstrated that they were not qualified for retention because they could not adapt socially or emotionally to military life, or because they lacked the aptitude, ability, motivation or self discipline for military service, or that they had demonstrated characteristics not compatible with satisfactory continued service. The separation policy applies to soldiers who cannot meet the minimum standards prescribed for successful completion of training because of lack of aptitude, ability, motivation or self-discipline. The regulation requires uncharacterized service for separation under this chapter.

(1) The issue is rejected. The Board carefully examined the applicant's record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as infractions of discipline, the extent thereof, and the seriousness of the offenses. The evidence of record shows that the applicant received an uncharacterized separation while in an entry-level status (ELS). The separation authority approved the applicant's discharge as entry-level status, with the description of service as uncharacterized. A soldier is in entry level-status for the first 180 days of continuous active duty. The purpose of the entry-level status is to provide the soldier a probationary period. Soldiers who are found to lack the necessary motivation, adaptability, self-discipline, ability, or attitude to become productive soldiers may be expeditiously separated while in entry-level status. An honorable discharge is rarely ever granted for an ELS. A fully honorable discharge may be granted only in cases, which are clearly warranted by unusual circumstances involving outstanding personal conduct and/or performance of duty. The Board determined that no such unusual circumstances were present in the applicant’s record and her service did not warrant an honorable discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief. See Paragraph 3, below.

The Board noted that the applicant's DD Form 214 erroneously shows the applicant's reason for separation to be "Entry Level Status Performance and Conduct." The appropriate entry should be "Entry Level Status." The Board will direct ARBA St. Louis to make an administrative change to the narrative reason for separation and issue the applicant a new DD Form 214.
