PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 17 March 1998, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—pattern of misconduct, with a recommendation for a general, under other than honorable conditions discharge (GD). The applicant was advised of her rights, consulted with legal counsel, was advised of the impact of the discharge action, and voluntarily waived consideration of her case by an administrative separation board contingent on receiving a GD, and she submitted a statement in her own behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 20 April 1998 , the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 6 May 1998, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 3 years, 3 months, and 27 days of active military service.

         c. The applicant’s record shows that she completed over 3 years of service and attained the rank of specialist/E-4. Her disciplinary record includes her acceptance of three Article 15’s: the first on 1 August 1997, for two specifications of dereliction of duty which resulted in a suspended reduction to private first class/E-3, which was vacated on 18 September 1997; the second on
29 September 1997, for three specifications of writing bad checks; and the third on 24 march 1998, for four specifications of writing bad checks which resulted in a reduction to private/E-2. Based on this disciplinary record the unit commander initiated separation action on the applicant based on a pattern of misconduct.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.


         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The Board noted the applicant’s contention, as outlined in her statement, that marital problems caused her financial misconduct; that because she was with a new unit she was uncomfortable going to his Noncommissioned Officers; and that her discharge has impacted her ability to get good employment; and she would now like to use her GI Bill to return to school. However, after carefully examining the applicant’s record of service for the period of enlistment under review, the Board determined that her discharge was appropriate. The applicant’s misconduct clearly diminished the quality of her service below that warranting a fully honorable discharge. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that her service mitigated the misconduct or poor duty performance. Finally, eligibility for veteran's benefits, to include educational benefits under the Montgomery GI Bill, does not fall within the purview of the Army Discharge Review Board. Accordingly, the applicant should contact a local office of the Department of Veterans Affairs for further assistance with this issue. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
