PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 7 April 1998, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—minor disciplinary infractions, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and voluntarily waived consideration of his case by an administrative separation board contingent upon receiving a GD, and elected not to submit a statement in his own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 23 April 1998, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 2 June 1998, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 1 year, 1 month, and 16 days of his current enlistment, and a total of 3 years and 7 months of active military service.

         c. The applicant’s record shows that he completed over 3 years of service; attained the rank of specialist/E-4; and earned a Good Conduct Medal. The applicant’s disciplinary history for the period of service under review, includes his acceptance of a summarized Article 15 on 12 September 1997, for two incidents of failure to go to his appointed place of duty and for being absent for one day. The record also shows that the applicant was barred from reenlistment on
27 October 1997, the unit commander cited the offenses for which the applicant received the Article 15 documented above, failure to maintain financial responsibility, driving with a suspended license, and speeding as the basis for imposing the bar. The unit commander processed the applicant for separation based on a pattern of misconduct, citing the applicant’s failure to maintain financial responsibility, failure to appear in court, failure to pay court fines, and several incidents of failure to go to his appointed place of duty, as the basis for taking the separation action.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

(1) The issue is rejected. The Board noted the applicant’s contention that, in effect, his discharge was inequitable because it was based on an isolated incident of financial problems. However, after carefully examining the applicant’s record of service for the period of enlistment under review, the Board determined that the applicant’s discharge was appropriate. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that his service mitigated his misconduct. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
