PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The available records do not contain the specific facts and circumstances surrounding the events which led to the applicant’s discharge from the Army. However, the record does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), authenticated by the applicant, which documents the following facts: Character of Service-General, Under Honorable Conditions (GD); Authority for Separation-Chapter 14, AR 635-200; and the Narrative Reason for Separation-Misconduct.

         b. The DD Form 214 also shows that on 12 August 1997, the applicant was discharged with a GD after completing 2 years, 1 month, and 21 days of active military service.

         c. The applicant’s records show that he completed just over 2 years of service and the highest rank he attained while on active duty was private first class/E-3. There are no documented acts of valor, significant achievement, or service warranting special recognition contained in the record. There is also no disciplinary history contained in the available records; however, it is evident the applicant had been reduced from the rank of private first class/E-3 down to private/E-1 which is the rank he held on the date he was discharged. The DD Form 214 also verifies that the applicant was separated based on displaying a pattern of misconduct.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.
         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (1) The issue is rejected. The Board noted the applicant’s contention, as outlined in the letter enclosed with his application, that in effect, he is trying to enroll in school but is being hampered by his GD; and he would like an upgrade to so that he can get on with a normal life. However, the Board found that the applicant's discharge was appropriate. The available records do not contain the specific facts and circumstances concerning events that led to the applicant’s discharge from the Army, but it does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was authenticated by the applicant. This document identifies the reason and characterization of the discharge and the Board presumed government regularity in the discharge process. Finally, the applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that his service mitigated his misconduct. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
