PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The available records do not contain the specific facts and circumstances surrounding the events which led to the applicant’s discharge. However, the record does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), authenticated by the applicant, which documents the following facts: Character of Service-General, Under Honorable Conditions (GD); Authority for Separation-Chapter l4, AR 635-200; and the Narrative Reason for Separation-Misconduct.

         b. The DD Form 214 also shows that on 16 July 1997, the applicant was discharged with a GD after completing 7 months and 27 days of active military service.

         c. The available records show the applicant completed less than a year of service and there is no indication that he ever advanced beyond the rank of private/E-1. There are no documented acts of valor, significant achievement, or service warranting special recognition contained in any of the available records. There is also no documented disciplinary history contained in the available records by the DD Form 214 documents that the applicant was separated based on displaying a pattern of misconduct.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.
         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (1) and (2) The issues are rejected. The Board noted the applicant’s contention that, in effect, it has been a year since his discharge and that he would like his discharge upgraded; and that he was told that after 6 months he could change his discharge. The US Army does not have, nor has it ever had, a policy to automatically upgrade discharges. Each case is decided on its own merits when an applicant submits a DD Form 293 requesting a change in discharge. Changes may be warranted if the Board determines that the characterization of service or the reason for discharge or both were improper or inequitable. Although, the available records do not contain the specific facts and circumstances concerning events that led to the applicant’s discharge from the Army, they do contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was authenticated by the applicant. This document identifies the reason and characterization of the discharge and the Board presumed government regularity in the discharge process. The Board, being convinced that the reason for discharge and the characterization of service were proper and equitable, voted to deny relief.
