8.       Remarks: There is no documented evidence to show that the applicant received nonjudicial punishment, under the provisions of Article 15 of the UCMJ. However, it is clear from the evidence of record that the applicant was reduced from the rank of sergeant/E-5 to specialist/E-4, and that he was relieved for cause based on his use of illegal drugs. This information is supported by an NCOER contained in the record and by the DD Form 214 (Certificate of Release or Discharge from Active Duty) issued the applicant at discharge.

PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The available records do not contain the specific facts and circumstances surrounding the applicant’s discharge. However, the record does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), authenticated by the applicant which documents the following facts: Character of Service-General, Under Honorable Conditions; Authority for Separation-Paragraph 14-12c(2), AR 635-200; and Narrative Reason for Separation-Misconduct.

         b. The DD Form 214 also shows that on 9 June 1998, the applicant was discharged with a GD after completing 1 year, 2 months, 15 days of his current enlistment, and a total of 11 years, 10 months and 11 days of active military service.

         c. The available records show that the applicant completed almost 12 years of service; attained the rank of sergeant/E-5; that he completed almost 8 years of foreign service; and that he had earned two Army Commendation Medals, six Army Achievement Medals, three Good Conduct Medals, the Armed Forces Expeditionary Medal, and the NATO Medal. There is no disciplinary records in the available records; however, it can be determined from the DD Form 214 that the applicant had be reduced to the rank of specialist/E-4 and that his misconduct discharge was the result of his abuse of illegal drugs.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.
