PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
         a. Evidence of record shows that on 15 May 1997, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—commission of a serious offense, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, requested a hearing by a board of officers and elected not to submit a statement in his own behalf. The intermediate commanders reviewed the proposed discharge action and recommended approval of the separation action; however, he recommended that the applicant receive an under other than honorable conditions (UOHC) discharge. An administrative separation board considered the applicant’s case; however, the board proceedings are not contained in the available records. The Commanding General reviewed the findings and recommendations of the administrative separation board and forwarded the board’s proceedings to Department of the Army (DA), the separation authority in this case, along with his recommendation that the applicant be discharged for abuse of illegal drugs with a UOHC discharge. On 21 May 1998, DA directed that the applicant be discharged with a UOHC characterization of service; that the applicant be reduced to the lowest enlisted grade; that he be assigned a Separation Program Designator (SPD) Code of JKQ; that he be assigned a Reentry Eligibility (RE) Code of 4.

         b. On 18 June 1998, the applicant was discharged with a UOHC discharge. At the time of discharge, the applicant had completed 3 years and 18 days service of his current enlistment, and a total of 19 years, 9 months and 7 days of active military service.

         c. The applicant’s record indicates that he completed over 19 years of service; attained the rank of Sergeant First Class; that he served in Operation Desert Storm; and that he earned two Army Commendation Medals, three Army Achievement Medals, the Southwest Asia Service Medal, the Kuwait Liberation Medal and five Good Conduct Medals. The record shows that the applicant had been reduced in rank to staff sergeant/E-6 and that he had tested positive for marijuana use during the enlistment under review. He was processed for separation for the commission of a serious offense based on the drug use; his case was considered by an administrative separation board; and his discharge approved at DA based on his having completed over 18 years of service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

(1) The issue is accepted. There was a full consideration of all service including the infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board determined that the characterization of service was inequitable because the quality of the applicant's service did not warrant the granting of an under other than honorable conditions discharge. The applicant's failure to perform in accordance with Army standards was mitigated by service of sufficient merit to warrant an upgrade of the discharge being reviewed. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to general, under honorable conditions. The Board determined that the reason for discharge was proper and equitable and voted not to change it.
