PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

          a. The evidence of record shows that on 11 July 1990, the applicant was found guilty by a special court-martial of stealing a helicopter cyclic grip, a 1200 ft spool of rope, a fire extinguisher, cargo straps, paint, various circuit breakers, helicopter electronic equipment, including a UH-60 emergency light panel, assembly, and various tools, property of US Government, of a collective value of approximately $3,000.00, between (890901 and 900223). He was sentenced to be discharged with a bad conduct discharge, confinement for a period of two (2) months, and reduction to E1. On 12 August 1990, the sentence was approved. On 26 September 1991, the sentence having been affirmed pursuant to Article 71(c) having been complied with; the sentence was ordered to be executed.

         b. On 24 September 1991, the applicant was discharged with a bad conduct discharge, under the provisions of Chapter 3, AR 635-200, by reason of as a result of court-martial. He was credited with 4 years, 4 months, and 29 days of active service on the enlistment under review.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 3, Section IV, establishes policy and procedures for separating members with a dishonorable or bad conduct discharge; and provides that a soldier will be given a bad conduct discharge pursuant only to an approved sentence of a general or special court-martial; and that the appellate review must be completed and the affirmed sentence ordered duly executed.

 (1) The issue is rejected. The Board carefully examined your record of service during the period of enlistment under review. The evidence of record clearly shows that you were adjudged guilty by court-martial and that the convening authority approved the sentence. Court-martial convictions stand as adjudged or modified by appeal through the judicial process. The ADRB is empowered to change the discharge only if clemency is determined to be appropriate. Clemency is an act of mercy, or instance of leniency, to moderate the severity of the punishment imposed. After a thorough review of your record and the issue submitted, the Board found no cause for clemency and therefore voted to deny relief.
