PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 17 June 1994, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—commission of a serious offense, with a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, requested consideration of my case by an administrative separation board, and submitted a statement in his own behalf. The unit commander subsequently recommended separation from the Army. On 28 June 1994, the separation authority directed that the applicant be discharged with a GD.

         b. On 1 August 1994, the applicant was discharged with an honorable discharge. At the time of discharge, the applicant had completed 3 years,
1 month, and 5 days service on his current enlistment.

         c. The applicant’s record shows that he accepted an Article 15 on 10 May 1994 for conspiring to commit and committing an assault which resulted in his reduction in rank to private/E-2. The applicant’s unit commander processed him for separation for commission of a serious offense based on these incidents and the separation authority approved the separation and directed a GD. However, the evidence of record shows that there are several administrative errors contained on the DD Form 214 (Certificate of Release or Discharge from Active Duty) issued the applicant at discharge. The most serious error is that someone in the discharge process erroneously changed the type of discharge and characterization of service to fully honorable, as opposed to the general, under honorable conditions discharge/characterization directed by the separation authority. There was also incorrect separation (SPD) and reentry (RE) code’s assigned which stemmed from an error in the authority for separation. The proper authority for separation, as initiated by the unit commander and approved by the separation authority, was Paragraph 14-12c, AR 635-200, commission of a serious offense. By regulation this would have resulted in the assignment of an SPD code of JKQ and an RE code of 3. Instead the DD Form 214 contained an incorrect authority for separation of 14-12c(2), commission of a serious offense-abuse of illegal drugs, which resulted in the assignment of an SPD code of JKK and an RE code of 4.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

3. Responses to items not addressed as decisional issues:

During the review of this case, the Board noted that someone in the discharge process erroneously changed the characterization of service directed by the separation authority. The separation authority directed that the applicant receive a general, under honorable conditions discharge. However, the DD Form 214 issued the applicant resulted in an honorable discharge. The Board elected not to correct this error based on its policy not to correct errors that result in a less favorable result for the applicant.

The Board has directed, in Part VIII of this document, that these administrative errors be corrected and the applicant be issued a new DD Form 214.
