PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 9 January 1984, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. On 12 January 1984, the Assistant Staff Judge Advocate determined the separation action to be legally sufficient. On 18 January 1984, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 30 January 1984, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 2 years, 8 months, and 13 days of active military service.

         c. The applicant’s record reflects that he completed just under 3 years of service; attained the rank of specialist/E-4; successfully completed an overseas tour in Germany; and earned the Army Achievement Medal. His disciplinary record includes his acceptance of an Article 15 for driving while drunk and for violating a lawful regulation by possessing a pistol. His punishment included a reduction in rank to private/E-2. The unit commander processed the applicant for separation for unsatisfactory performance, indicating that he would continue to be a disruption to the command, citing the incidents for which he received the Article 15 and a suicide attempt as the basis for taking the action. The applicant did undergo a mental status evaluation which indicated he was medically fit for retention and cleared him for administrative separation action as deemed appropriate by the command.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.
         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (1) and (2) The issues are rejected. The Board noted the applicant’s contentions that his discharge was inequitable because it was based on an isolated incident and that he received an Army Achievement Medal. However, after carefully examining the applicant's record of service for the enlistment under review, the Board determined that the applicant’s misconduct clearly diminished the quality of his service below that meriting a fully honorable discharge. There was a full consideration of all faithful and honorable service as well as infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board concluded that the discrediting entries in the applicant's record were not outweighed by prior or subsequent service of sufficient merit to warrant an upgrade of the discharge being reviewed. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
(3) The issue is rejected. The Board noted the applicant’s contention that his discharge should be upgraded because he has been declared 100 percent disabled by the Department of Veterans Affairs. However, this factor does not provide a basis to upgrade the discharge. The VA is allowed by law to award compensation for a medical condition which was incurred in or aggravated by active military service; however, they are not required by law to determine medical unfitness for further military service. The VA, in accordance with its own policies and regulations, awards compensation solely on the basis that a medical condition exists and that said medical condition reduces or impairs the social or industrial adaptability of the individual concerned. Consequently, due to the two concepts involved, an individual's medical condition, although not considered medically unfitting for military service at the time of processing for separation, may be sufficient to qualify the individual for VA benefits based on an evaluation by that agency.
