1. APPLICANT REQUESTS : That his discharge under other than honorable conditions be recharacterized to an honorable.

APPLICANT CONTENDS : That he received a letter stating his discharge might be upgraded and requests more information.

3. COUNSEL CONTENDS : The applicant is currently not represented by counsel.

SUMMARY OF SERVICE :

Records show the applicant completed high school before enlisting in the Army in January 1990 for three years for training of choice as a cannon crew member. He completed basic and advanced individual training and was assigned to Fort Bragg, North Carolina with a reporting date of April 1990.

The applicant was reported AWOL on 23 May 1990 and dropped from the rolls on 22 June 1990. Evidence of record show that the applicant was apprehended by civilian authorities for the civilian charges of no license and no insurance on 14 August 1990. On 15 August 1990, the civil charges were dropped and the applicant was returned to military control in Atlanta, Georgia and assigned to Fort Knox, Kentucky.

The facts and circumstances of his separation processing are not contained in his personnel records; however, his records contain a DD Form 214 (Certificate of Release or Discharge from Active Duty) which shows that he was discharged under other than honorable conditions under the provisions of Army Regulation 635-200, chapter 10, for the good of the service in lieu of court-martial. He had
6 months and 29 days of creditable service and 84 days lost.

LEGAL/REGULATORY BASIS FOR SEPARATION :

Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 10 of that regulation provides, in pertinent part, that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for discharge for the good of the service in lieu of trial by court-martial. The request may be submitted at any time after charges have been preferred and must include the individual's admission of guilt. Although an honorable or general discharge is authorized, a discharge under other than honorable conditions is normally considered appropriate.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical numbers below corresponds to the issue numbers on the DD Form 293, or in Part VI, Paragraph 1, above.

         (1) The issue is rejected. The evidence of record shows the applicant was charged with the commission of an offense punishable under the Uniform Code of Military Justice (UCMJ) with a punitive discharge. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. There was a full consideration of all service including the infractions of discipline, the extent thereof, and the seriousness of the offenses
. It also noted that the characterization of service for this type of discharge is normally under other than honorable conditions and that the applicant was aware of that prior to requesting discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
