PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 13 June 1995, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635 200, by reason of unsatisfactory performance, with a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement on his behalf. The unit commander subsequently recommended waiver of further rehabilitative efforts. On 14 June 1995, the separation authority directed that the applicant be discharged with a GD.

         b. On 11 July 1995, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 2 years, 3 months, 5 days of his current enlistment and a total of 6 years active military service.

         c. The applicant’s record shows that the he attained the rank of specilaist/E-4; completed an overseas tour in Germany; served a combat tour in Saudi Arabia; and earned the Good Conduct Medal, the Southwest Asia Service Medal, the Kuwait Liberation Medal, the Overseas Service Ribbon, and the Army Service Ribbon. The applicant’s disciplinary record includes his acceptance of an Article 15 on 2 May 1995 for two specifications of failing to go to his prescribed place of duty. His punishment for these offenses included a reduction in rank to private first class/E-3. There was also an extensive record of counseling for a myriad of infractions related to indebtedness and misconduct. The unit commander cited the applicant’s pattern of indebtedness and misconduct as the basis for taking separation action. Procedurally soldiers are eligible to have their cases considered by an administrative separation board if they have completed 6 or more years of credible service at the time separation action is initiated. The applicant had completed 5 years, 11 months, and 2 days of military service at the time his separation was initiated and was ineligible for an administrative separation board by 28 days.

Legal/Regulatory basis for separation : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

(1), (2), (3), and (4) The issues are rejected. The Board noted the applicant’s contentions that his wife was responsible for his indebtedness; that his commander felt he had no control of his wife; that he found it impossible to support his family; and that he had 6 good years of honorable service. However, after carefully examining the applicant's record of service during the period of enlistment under review, the Board concluded, these issues did not provide a sufficient basis upon which to grant relief. There was a full consideration of all faithful and honorable service as well as infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board concluded that the discrediting entries in the applicant's record were not outweighed by prior or subsequent service of sufficient merit to warrant an upgrade of the discharge being reviewed. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
