1. Summary of facts and circumstances concerning discharge:
Undated: Applicant was charged with Assault, drunk driving, failure to register
his weapons, failure to properly store weapons in the unit arms room,
wrongful transportation of weapons, possession of a billy club,
possession of a controlled substance and breaching the peace.
950425: Applicant consulted legal counsel, requested discharge under the
provision of Chapter 10, AR 635-200, in lieu of trial by court-martial
and submitted a statement in his own behalf.
950504: Separation authority approved separation with an under other than
honorable conditions discharge.
950511: Applicant was discharged.

2. Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on issues of propriety and/or equity:

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical numbers below corresponds to the issue numbers on the DD Form 293, or in Part VI, Paragraph 1, above.

(1),(2) The issues are rejected. The Board examined the applicant's record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board concluded that the discrediting entries in the applicant's record were not outweighed by prior or subsequent service. The evidence of record shows the applicant was charged with the commission of offenses punishable under the Uniform Code Of Military Justice with a punitive discharge. The Board noted that after consulting with legal counsel, the applicant voluntarily, and in writing, requested separation from the Army in lieu of trial by court-martial. By doing so, the applicant admitted guilt to the offenses of assault, failing to register weapon/storing/transporting,drunk driving and others punishable under the Uniform Code Of Military Justice. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. Finally, the Board considered the applicant's entire record of service for the period under review. It also noted that the characterization of service for this type of discharge is normally under other than honorable conditions and that the applicant was aware of that prior to requesting discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
