830721: Unit commander in consultation with clinical director/ADAPCP declared
applicant a rehabilitation failure.
830830: Unit commander notified the applicant of initiation of separation
action under the provisions of Chapter 9, AR 635-200, for alcohol abuse
- rehabilitation failure. He was advised of his rights.
830928: DA, USA Regional Center, Nurnberg, APO New York, Orders 271-204,
discharged applicant from the Regular Army.
831012: Applicant was discharged.

2. Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on issues of propriety and/or equity:

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

        b. Equity:       The parenthetical numbers below corresponds to the issue numbers on the DD Form 293, or in Part VI, Paragraph 1, above.

(1), (3) The issues are rejected. The applicant, by violating the Army's alcohol abuse policies, compromised the special trust and confidence placed in the soldier at the time. The applicant had a duty to support and abide by the Army's alcohol policies and not abuse alcohol. The Board found that the chain of command did provide the applicant with adequate rehabilitative opportunities and that further efforts were not practical, rendering the applicant a rehabilitation failure. By abusing alcohol, the applicant knowingly risked a military career. This misconduct diminished the quality of his service below that meriting a fully honorable discharge and the Board voted to deny relief.

(2) The issue is rejected. The record contains no evidence that the command refused the applicant’s request for leave. Be that the case, there is no indication that the command responded in an other than proper manner.
