Unknown:        In consultation with the unit commander, the ADAPCP/counselor                      declared the applicant a rehabilitation failure.
931005:         Unit commander notified applicant of initiation of separation action              under the provisions of Chapter 9, AR 635-200, for drug                                     rehabilitation failure. He was advised of his rights.
931005:         Separation authority approved separation with a general under             honorable conditions discharge.
931018:         Applicant was discharged.

2. Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on issues of propriety and/or equity:

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical numbers below corresponds to the issue numbers on the DD Form 293, or in Part VI, Paragraph 1, above.

(1),(2),(3),(4) The issues are rejected. The applicant, by violating the Army's policy not to possess or use illegal drugs, compromised the trust and confidence placed in the applicant as a soldier at the time. As a soldier the applicant had the duty to support and abide by the Army's drug policy. By using illegal drugs the applicant knowingly risked receiving a less than fully honorable discharge. Before initiating action to separate the applicant, the command ensured the applicant was counseled at least once about the deficiencies which could lead to separation. Additional formal counseling is discretionary. The Board noted the command made an assessment of the applicant’s potential for becoming a fully satisfactory soldier. The evidence of record established that the applicant was afforded a reasonable opportunity to overcome noted deficiencies. As the applicant did not subsequently conform to required standards of discipline and or performance, the command appropriately determined the applicant did not demonstrate the potential for further military service. The Board was satisfied that all requirements of law and regulations were met and the rights of the applicant were fully protected throughout the separation process. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
