         910220:  Applicant declined a separation medical examination.
         910226:  Applicant was charged with two specifications of AWOL
                  (900621-900709) (900713-910215).
         910226:  Applicant consulted legal counsel, requested discharge under the                  provisions of Chapter 10, AR 635-200, in lieu of trial by court-                           martial, and did not submit a statement in his own behalf.
         910416:  Unit commander recommended approval with an under other than                       honorable conditions discharge.

2. Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on issues of propriety and/or equity:

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical numbers below corresponds to the issue numbers on the DD Form 293, or in Part VI, Paragraph 1, above.

(1, 2, 3, 4, 5, 6, 7) The issues are rejected. The applicant's discharge was appropriate because the quality of service determination at the time of discharge was consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. By misconduct and poor duty performance the applicant diminished the quality of service below that meriting a fully honorable or general discharge. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or the applicant’s service mitigated the misconduct or poor duty performance. The evidence of record shows the applicant was charged with the commission of offenses punishable under the Uniform Code Of Military Justice with a punitive discharge. The Board noted that after consulting with legal counsel, the applicant voluntarily, and in writing, requested separation from the Army in lieu of trial by court-martial. By doing so, the applicant admitted guilt to the offenses of two counts of being AWOL. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. Finally, the Board considered the applicant's entire record of service for the period under review. It also noted that the characterization of service for this type of discharge is normally under other than honorable conditions and that the applicant was aware of that prior to requesting discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.


(8, 9) The issues are rejected. The record does not support the applicant's contention, and no evidence to support it has been submitted by the applicant, that his family problems or personal problems adversely affected his ability to serve in the military. Even if true, the Board was of the opinion that the applicant had many other legitimate avenues open to him without committing the serious offenses which led to his discharge under review.
