THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that a DA Form 1059 (Service School Academic Evaluation Report) for the Warrior Leader Course (WLC) showing he "marginally achieved course standards" be replaced with a DA Form 1059 showing he "achieved course standards."

2.  The applicant states he attended the WLC in 2007 and upon arrival was given an Army Physical Fitness Test (APFT) and tape test.  He passed the APFT but failed the tape test by 1 percent.  As a result of failing the tape test by only 1 percent, he was given the opportunity and time to "make tape," which he did.  As a result he was given an "achieved course standards" DA Form 1059.  Both forms had been included in his record and as he was preparing for an E-7 promotion board, he requested that the older form be deleted.  As a result of his request the wrong form was deleted.  Because of this he now has only the "marginally achieved course standards" WLC DA Form 1059 in his records.

3.  The applicant provides copies of DA Forms 1059 in question.

CONSIDERATION OF EVIDENCE:

1.  The applicant, currently a Regular Army staff sergeant, enlisted on 2 February 2004.  He was promoted to sergeant, effective 1 December 2006, and attended the WLC from 31 July 2007 through 29 August 2007.

2.  A "marginally achieved course standards" DA Form 1059 documenting WLC states the applicant failed the height and weight standards.  A copy of the form is included in his official records.  He signed and dated the form two days before the end of the course.  

3.  The "achieved course standards" DA Form 1059, which he appears to have also signed and dated two days before the end of the course, makes no mention of height and weight standards.  Other comments are the same on both forms.

4.  The applicant's first Noncommissioned Officer Evaluation Report (NCOER) of record, for the period 19 March 2007 – 30 September 2007, and all subsequent NCOER's show he has passed all APFTs and met height and weight standards. 

5.  Army Regulation 623-3 (Evaluation Reporting System) states Soldiers attending institutional training courses are expected to meet the Army’s physical fitness and body composition standards.  All professional military education courses beyond initial military training that are 60 days or longer require an APFT and height and weight screening.  

6.  Department of Army Pamphlet 623-3 states Soldiers who meet course standards but fail the height and weight standards will be marked as "marginally achieved course standards."  

DISCUSSION AND CONCLUSIONS:

1.  The reason for the issuance of two DA Forms 1059 for the WLC is not addressed in the applicant's official record and only the "marginally achieved course standards" form is currently filed in his official records.

2.  Based on the issuance of two DA Forms 1059 and the fact that the applicant has passed all subsequent APFT's, it is reasonable to accept his explanation as a basis for replacing the "marginally achieved course standards" DA Form 1059 with the "achieved course standards" DA Form 1059.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by removing from his official military personnel file the "marginally achieved course standards" DA Form 1059 for the WLC and replacing it with the "achieved course standards" DA Form 1059.
