IN THE CASE OF:
BOARD DATE: 9 April 2015
DOCKET NUMBER: AR20150004912
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
CONSIDERATION OF ADDITIONAL EVIDENCE:
11. On 26 March 2015, new information was received from the Defense Finance and Accounting Service (DFAS) in regard to the decision of the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20140016974, dated 18 November 2014.
12. The evidence submitted consists of a message from DFAS requesting that the proceedings be corrected to contain specific language regarding the payment for post-deployment/mobilization respite absence (PDMRA) to the applicant.
ADDITIONAL DISCUSSION AND CONCLUSIONS:
4. At the time of the decision of the ABCMR in Docket Number AR20140016974, dated 18 November 1974, it was the intent of the ABCMR to make the applicants record as administratively correct as it should properly have been at the time.
5. The ABCMR's decision in Docket Number AR20140016974 failed to specify in the Boards determination that the applicant was to be paid $200 per day of unused PDMRA in accordance with the provisions of Section 605 of the Fiscal Year 2013 National Defense Authorization Act.
6. Accordingly, the Record of Proceedings should be corrected to read in Paragraph 1 of the Board Determination/Recommendation "The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected to show that he accrued 82 days of PDMRA prior to his release from active duty on 6 February 2014 and that he should be paid $200.00 for each day of his PDMRA credit in accordance with the provisions of Section 605 of the Fiscal Year 2013 National Defense Authorization Act."
BOARD VOTE:
____X____ ___X____ ___X_____ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
________ ________ ________ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
1. The Board determined that the evidence presented was sufficient to warrant amendment of the decision of the Army Board for Correction of Military Records set forth in Docket Number AR20140016974, dated 18 November 2014, by replacing paragraph 1 to show "The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.

On 24 May 11, after a thoroughly considering the facts and circumstances of the applicants case, the Board determined the evidence he had provided was sufficient to conclude that he should have been credited with 32 days of PDMRA credit at the end of his mobilization tour and recommended correcting the applicants records to reflect that he was not released from active duty on 6 Apr 09, but continued to serve on active duty for 32 additional days for the purpose of utilizing his...

The applicant states he was only able to take 36 days of PDMRA based on a letter from the U.S. Army Human Resources Command (HRC) stating he had only accrued 36 days of PDMRA. After he was released from active duty (REFRAD) he was notified by HRC that he was entitled to 82 additional days of PDMRA and that he had to apply to the Board for relief. The PDMRA Calculator now provided by HRC indicates the applicant earned 118 days of PDMRA and that he used 36 days, leaving a total of 82 days.

STATEMENT OF FACTS: PDMRA is a program intended to recognize service members who are mobilized beyond certain rotation frequency thresholds (12 months in any 72-month period for Reserve Component members) by awarding them administrative absence days. While the OPR recommends only 12 days be granted (due to the applicants performing two days of military duty during the PDMRA period), it must be noted the provisions of the FY13 NDAA provide that members in the applicants situation are to be...

The applicant states, in effect, that he elected to have his PDMRA added to his active duty time and his PDMRA was incorrectly calculated as being only 1 day instead of 25 days which denied him additional active duty time, pay and allowances for 24 additional days of leave time, 24 retirement points, 24 days of Tri-care, and 24 days of TAMP benefits.
