IN THE CASE OF:
BOARD DATE: 22 September 2015
DOCKET NUMBER: AR20150001142
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show both of his reenlistment periods vice showing only his immediate reenlistment as 19 May 2008 to 14 June 2012.
2. The applicant states during his service in the military he reenlisted twice. The first reenlistment was on 19 May 2007 (i.e., 2008) and the second was on 2 February 2009. However, only his first reenlistment is shown on his DD Form 214. Although he was discharged under honorable conditions in 2012, he had never been in trouble during the rest of his career in the military. Unfortunately, he got in trouble during a mass draw-down [of the Army]. His second reenlistment shows evidence of honorable service exceeding 24 months and qualifies him to receive his GI Bill education benefits.
3. The applicant provides a DD Form 4 (Enlistment/Reenlistment Document - Armed Forces of the United States), dated 2 February 2009, and four certificates.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the Regular Army (RA) on 16 November 2006. He was subsequently assigned to the 632nd Maintenance Company, 87th Combat Sustainment Support Battalion (CSSB), Fort Stewart, GA.
2. He served in Iraq while assigned to the 632nd Maintenance Company from 26 October 2007 to 26 January 2009. His record contains a DD Form 4, dated 19 May 2008, wherein it shows he reenlisted on that date in the RA for a period of 2 years at the 632nd Maintenance Company, 87th CSSB, Iraq. This form also shows he was reenlisting for the current station option and it was his 1st reenlistment.
3. The applicant provides, and his record contains, a DD Form 4, dated 2 February 2009, wherein it shows he reenlisted on that date in the RA for a period of 4 years at the 632nd Maintenance Company, 87th CSSB, Fort Stewart, GA.
4. He was subsequently assigned to Headquarters and Headquarters Detachment (HHD), 192nd Ordnance Battalion (OD), Fort Bragg, NC.
5. He was discharged under honorable conditions on 14 June 2012 at Fort Bragg, NC. Item 18 (Remarks) of the DD Form 214 he was issued, in part, contains the entry IMMEDIATE REENLISTMENTS THIS PERIOD -- 20080519-20120614.
6. Army Regulation 635-5 (Separation Documents) then in effect, prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for preparation of the DD Form 214. It states, in part, for Soldiers with more than one enlistment period during the time covered by the DD Form 214, in item 18 enter IMMEDIATE REENLISTMENTS THIS PERIOD and specify inclusive dates for each period of reenlistment.
DISCUSSION AND CONCLUSIONS:
The evidence of record confirms the applicant reenlisted in the RA on 19 May 2008 and 2 February 2009 while his DD Form 214 only shows one period of his reenlistment. Therefore, it would be appropriate to correct his DD Form 214 to show his immediate reenlistments as 19 May 2008 to 1 February 2009 and 2 February 2009 to 14 June 2012.
