THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests inclusion of the Airborne Course on her DD Form 214 (Certificate of Release or Discharge from Active Duty).
2. The applicant states she completed the course but it is not listed on her
DD Form 214.
3. The applicant provides copies of her DD Form 214 and an Airborne Course Diploma.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant enlisted in the Regular Army on 10 March 1988, completed training, and was awarded military occupational specialty 27E (Dragon Repairer).
3. The available record contains no significant documentation of her period of service.
4. The U.S. Army Infantry School Airborne Course Diploma provided by the applicant shows she completed the Basic Airborne Course on 9 December 1988 (a 3 week course).
5. The applicant was released from active duty on 1 February 1992. Her
DD Form 214 shows:
a. Award of the Army Service Ribbon, Army Lapel Button, National Defense Service Medal, Southwest Asia Service Medal with two bronze service stars, Sharpshooter Marksmanship Qualification Badge with Rifle Bar, and Army Good Conduct Medal.
b. Completion of the TOW/Dragon Repairer course and the Bradley Fighting Vehicle System TOW/Dragon Repairer course.
DISCUSSION AND CONCLUSIONS:
The applicants Airborne Course Diploma is accepted as sufficient evidence to correct her DD Form 214 to show Basic Airborne Course, 3 weeks, 1988.
