THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, reconsideration of his prior request for correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to reflect award of the Holland Four Day Event Cross (Nijmegen March) and, as a new issue, correction of his DD Form 214 to show award of the Cold War Recognition Certificate.

2.  The applicant states he received approval of both after retiring from the Army.

3.  The applicant provides:

* U.S. Army Human Resources Command (HRC), memorandum, dated 
14 March 2014
* Cold War Recognition Certificate
* Army Review Boards Agency letter to applicant, dated 19 February 2013

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20120012233 on 31 January 2013.

2.  The applicant provides copies of the HRC memorandum approving the Holland Four Day Event Cross (Nijmegen March) and the Cold War Recognition Certificate which were not previously considered by the Board and warrant consideration at this time.

3.  The applicant was appointed as a commissioned officer in the U.S. Army Reserve on 30 July 1990.  He entered active duty on 29 January 1991, where he was appointed as a Regular Army commissioned officer and continued to serve until his retirement on 28 February 2011.

4.  The DD Form 214 he was issued upon retirement does not show award of the Cold War Recognition Certificate or the Holland Four Day Event Cross.

5.  On 15 June 2012, the applicant applied to the ABCMR, requesting award of the Holland Four Day Event Cross and correction of his DD Form 214 to show award of the Army Superior Unit Award.  On 31 January 2013, the Board granted his request to correct his DD Form 214 to show award of the Army Superior Unit Award and on 27 February 2013 issued him a DD Form 215 (Correction to 
DD Form 214).  His request for award of the Holland Four Day Event Cross was denied based on insufficient evidence.

6.  On 12 June 2013, the applicant applied to the ABCMR, requesting award of the Holland Four Day Event Cross and subsequent entry of the award on his 
DD Form 214.  He was advised per letter, dated 7 February 2014, to exhaust all administrative remedies available to him and forward his proof of participation in the event to HRC for approval.

7.  On 14 March 2014, HRC approved the acceptance and wear of the Holland Four Day Even Cross (Nijmegen March) and filed a copy of the approval memorandum in the applicant’s Official Military Personnel File (OMPF).

8.  The applicant provided a copy of the Cold War Recognition Certificate issued to him by HRC.

9.  Army Regulation 600-8-22 (Military Awards) provides policy, criteria, and administrative instructions concerning individual military decorations, Army Good Conduct Medals, service medals and ribbons, combat and special skill badges and tabs, unit decorations, and similar devices awarded in recognition of accomplishments.

	a.  Paragraph 10-12, states that Public Law 105-85, Section 1084,established a Cold War Recognition Certificate to recognize all service members of the U.S. Armed Forces and qualified Federal Government civilian personnel who faithfully and honorably served the United States during the Cold War Era from 2 September 1945 to 26 December 1991.  
	b.  Paragraph 9-27 pertains to the acceptance and wear of foreign decorations.  It states foreign decorations listed in appendix E are not annotated in an individual’s DA Form 4037 or Enlisted Record Brief or entered on the DD Form 214.  The approval memorandum for acceptance and wear of a foreign decorations endorsed by the first general officer in the chain of command or from HRC Awards and Decorations Branch to include a copy of the certificate and its supporting documents will be entered in the OMPF of the recipient.

	c.  Appendix E, Table E-1, (Foreign Decorations), lists the Holland Four Day Event Cross as a foreign decoration approved for acceptance and wear.

	d.  Paragraphs 1-41 and 1-42 rank decorations, the Army Good Conduct Medal, service medals, and service ribbons in the order of precedence when worn or displayed.  Neither the Cold War Recognition Certificate nor the Holland Four Day Event Cross are listed in the order of precedence for individual awards and decorations.

10.  Army Regulation 635-5 (Separation Documents), in effect at the time, established standardized policy for preparing and distributing the DD Form 214.  It stated to enter in item 13 of the DD Form 214 awards and decorations for all periods of service in the priority sequence specified in Army Regulation 600-8-22.

DISCUSSION AND CONCLUSIONS:

1.  The applicant’s request to correct his DD Form 214 to reflect award of the Holland Four Day Event Cross and the Cold War Recognition Certificate was carefully considered, but found to be without merit.

2.  HRC approved the acceptance and wear of the Holland Four Day Event Cross (Nijmegen March) and issued him a Cold War Recognition Certificate, filing a copy of both in the applicant’s OMPF.

3.  Regulatory guidance does not call for the annotation of either of these forms of recognition on the DD Form 214.

The evidence presented does not demonstrate the existence of a probable error or injustice.  Therefore, the Board determined the overall merits of this case are insufficient as a basis to amend the decision of the ABCMR set forth in Docket Number AR20120012233, dated 31 January 2013.
