THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, retroactive award of a Dental Officer Multi-Year Retention Bonus (DOMRB) effective 25 February 2012 through 24 February 2016.

2.  The applicant states she submitted the DOMRB paperwork in February 2012 to the Fort Meade Dental Activity headquarters.  The appropriate paperwork was submitted to her command and signed by her and her commander.  The contract did not reach the U.S. Army Human Resources Command (HRC) or the Office of The Surgeon General.  

3.  The applicant provides copies of her Request for DOMRB memorandum and 2014 and 2016 Dental Examiners licenses.

CONSIDERATION OF EVIDENCE:

1.  The applicant was commissioned in the Regular Army, Medical Corps, on 14 July 2004.  

2.  She provided copies of the following:

* Request for DOMRB memorandum she completed and signed on 21 February 2012 for the 4-year DOMRB effective 25 February 2012; the request was approved by her command on the same date
* 2014 and 2016 Dental Examiners licenses

3.  In an advisory opinion, dated 4 February 2015, the Chief, Army Medical Department (AMEDD) Special Pay Branch, reiterated the applicant's request.  The AMEDD Special Pay Branch official stated:

   a.  Current policy required contracts to be prepared via the Medical Operational Data System (MODS) special pay module.  The contract must be executed by signature up to 90 days in advance or within 30 days after the effective date; otherwise, the effective date must be reestablished as the date of signature.  All contracts executed outside of the policy for signature date or received outside the funded fiscal year, were returned without action.

   b.  A review of applicant's special pay and finance data indicated that she was currently in a 4-year DOMRB at $50,000/year effective 26 February 2011 through 25 February 2015.  In this case, the MODS special pay module was not yet implemented to prepare and track the contract, there was no way to determine what happened to this requested 4-year DOMRB contract at $50,000/year effective 25 February 2012 through 24 February 2016.

   c.  Providing the officer the benefit of the situation, she would be eligible to receive the 4-year DOMRB contract at $50,000/year effective 25 February 2012 through 24 February 2016.  That action would require a change to the contractual period from 26 February 2011 through 25 February 2015 to 25 February 2012 through 24 February 2016.  The last anniversary payment of $50,000 would be due the applicant on 25 February 2015.

4.  The advisory opinion was forwarded to the applicant for acknowledgment and comment on 6 February 2015.  She did not respond.

DISCUSSION AND CONCLUSIONS:

1.  The evidence shows the applicant is currently in a 4-year DOMRB effective 26 February 2011 through 25 February 2015.  The AMEDD Special Pay Branch verified that she is fully eligible for the requested 4-year DOMRB contract effective 25 February 2012 through 24 February 2016 with a change to her previous contractual period.  

2.  In view of the foregoing, her records should be corrected by changing her previous contractual period from 26 February 2011 through 25 February 2015 to 25 February 2012 through 24 February 2016.

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing she was approved for the 4-year DOMRB effective 25 February 2012 through 24 February 2016 with a change to her previous contractual period.
