THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests reconsideration of his previous request for correction of his DD Form 214 (Armed Forces of the United States Report or Transfer or Discharge) to show the spelling of his last name as "CHANDLER."
2. The applicant states:
* when he joined the Army at 17 years of age he noticed that his name was misspelled on his birth certificate
* his grandmother told the recruiter the doctor who filled out the birth certificate made a mistake because she could not read or write
* the recruiter instructed him to fill out his enlistment documents
* the recruiter assured them that the Army would help to correct it after he enlisted
* he asked his commanding officers for help with negative results and was told it was not a priority
* he was proud to be a Soldier and thought that he would continue his education and get his birth certificate corrected but that was not the case
* he was trained as an infantryman with people that did not want to be in the Army and he was criticized for wanting to help his country
* when he asked to be transferred to the Vietnam, he was told that he was too young and he was assigned to Alaska
* after he turned 18 he was told he could not go to Vietnam because he was his mothers only son
* when he went to get eyeglasses while in Alaska he signed his last name "CHANDLER " as had been doing his whole life because he forgot to use the name he was instructed to use by the recruiter
* he has served his country his whole life as a Soldier on active duty and in the Army National Guard and as a decorated police officer
* he has received many post service accomplishments
* in the past year he had his last name corrected on his birth certificate
3. The applicant provides:
* self-authored statement
* DD Form 214
* birth certificates
* National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service)
* information pertaining to post service accomplishments
CONSIDERATION OF EVIDENCE:
1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20130004541 on 21 October 2013.
2. The applicant's military records contain a DD Form 398 (Statement of Personal History) that he completed during his enlistment processing. It includes both his and his father's name and lists his last name as "CHANLER."
3. The DD Form 4 (Enlistment Contract Armed Forces of the United States) prepared during his enlistment processing shows his last name as "CHANLER." The applicant also authenticated this document by signing the same last name.
4. On 19 January 1968, the applicant enlisted in the Regular Army. The DA Form 20 (Enlisted Qualification Record) prepared upon his entry on active duty lists his last name as "CHANLER."
5. On a DA Form 428 (Application for Identification Card), dated 24 January 1968, it appears he signed his last name "CHANDLER."
6. A DD Form 771 (Spectacles Prescription), dated 6 September 1968, lists his last name as "CHANDLER."
7. On 15 January 1970, the applicant was released from active duty. His DD Form 214 lists the same last name as recorded on his DD Form 4, DA Form 20, and other documents filed in his military records.
8. An NGB Form 22 issued subsequent to his release from active duty lists his last name as "CHANDLER."
9. He provides a birth certificate that shows last name as "CHANDLER."
10. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for preparation of the DD Form 214. It states the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge.
DISCUSSION AND CONCLUSIONS:
1. Although most of the applicant's service records contain documents showing his last name as "CHANLER", evidence shows that on at least one occasion he signed his name as "CHANDLER."
2. His service records contain documents showing his last name as both "CHANLER" and "CHANDLER." His birth certificate and his NGB 22 show his last name as "CHANDLER"; however, his DD Form 214 shows his name as "CHANLER."
3. The inconsistent use of his last name may create administrative problems and could raise questions for the applicant in the future.
4. Therefore, it would be appropriate to correct his DD Form 214 to show his last name as "CHANDLER" as shown on his NGB Form 22.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined the evidence presented is sufficient to warrant an amendment of the ABCMR decision in Docket Number AR20130004541, dated 21 October 2013. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting the name on his DD Form 214 and replacing it with the name that is listed on his NGB Form 22.
