THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his previous request to correct his records by:

   a.  correcting his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his correct military occupational specialty (MOS) with the Special Qualification Identifier (SQI) "H" (Instructor); and

   b.  placing his DA Forms 2627 (Record of proceedings Under Article 15, UCMJ) in his restricted fiche if the Board will not reconsider removing them altogether from his Official Military Personnel File (OMPF).

2.  The applicant states he was awarded the "Hotel (H)" SQI by Orders 11-18, dated 14 January 1985 and his MOS should therefore be shown as "13F30X3H."

3.  The applicant provides:

	a.  a Mothers Against Drunk Drivers (MADD) Certificate of Merit; 

	b.  Delaware State Police Academy Certificates for DUI (Driving Under the Influence) Detection and Intoxilyzer Certification; 

	c.  a copy of US Army Field Artillery School Instructor training Course Diploma; and

	d.  a copy of Army Board for Correction of Military Records (ABCMR) Record of Proceedings AR20090000773.

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the ABCMR in Docket Number AR20090000773 on 11 June 2009.

2.  The applicant states the DD Form 215 (Correction to DD Form 214) that he received as a result of the Board's original determination in his case did not correct his MOS.  This is considered new argument and requires reconsideration by the Board.  The applicant offers no new argument or evidence concerning the Board's actions relative to his DA Forms 2627 other than to ask if the Board will not remove the record, then at least transfer it to the restricted portion of his OMPF.

3.  The Board's original proceedings provided that Orders 11-18, US Army Regional Personnel Center, Grafenwoehr, Germany, dated 14 January 1985, awarded the applicant the primary MOS 13F3H, indicating his status as an instructor.

4.  In the original case, the Board determined that the evidence presented was sufficient to warrant correction of the applicant's MOS by deleting from Block 11 of his DD Form 214 the entry "13F3X30, Fire Support Specialist" and replacing it with the entry "13F3OX3, Fire Support Sergeant.  This correction did not address the applicant's issue concerning a "Hotel (H)" SQI.

5.  The applicant's 31 August 1987 Personnel Qualification Record showed his primary MOS as 13F3HX3.  It also showed that he did not possess language skills, making his complete MOS 13F3HX3OO.

6.  Army Regulation 611-201 (Personnel Career Management Fields and Military Occupational Specialties) prescribes the policies and procedures for the career management of enlisted Soldiers.  Additional Skill Identifiers (ASI) identify specialized skills that are closely related to and are in addition to those required by the MOS.  Further, an ASI is authorized for use only with a designated MOS and will be listed in each specification for such MOS.  ASIs include operation and maintenance of specific weapons systems and equipment that are too restricted in scope to comprise an MOS.  Table 2-13F-2 within this regulation identifies MOS 13F3O with its applicable ASI as X3 and its accompanying title is Fire Support Sergeant.

7.  Army Regulation 611-1 (Military Occupational Classification Structure Development and Implementation) prescribes policies and responsibilities for developing, maintaining, evaluating and revising the military occupational classification and structure (MOCS) for enlisted career management field (CMF), MOS, SQI and ASI.  The MOSC contains nine characters and provides more specific occupational identity than the MOS. The MOSC is used to classify both personnel and positions in authorization documents. The elements of the MOSC include: 

	a.  First Three Characters (e.g., 13F) – this is a three-character numeric-alpha combination that identifies the MOS without regard to level of skill.  The first two characters relate to the MOS and do not identify the CMF of which the MOS is a part.

	b.  Fourth Character (e.g., 13F3) – this is a number.  With the first three characters, it shows skill and grade level in the MOS.  Authorized skill levels and the characters that identify them are described in DA Pam 611-21.

   c.  Fifth Character (e.g., 13F3H) – this may be a letter or a number that reflects SQI's common to a number of positions and MOS.  DA Pam 611-21 describes authorized SQI codes.  The letter "O" will always be inserted as the fifth character when a position does not require special qualifications or an individual is not qualified for award of an SQI.  The letter "H" represents the instructor special qualification.

   d.  Sixth and Seventh Characters (e.g., 13F3HX3) – these may be alpha-numeric or numeric-alpha characters that represent ASIs.  ASI codes are used to identify skills closely associated with, but in addition to, those in the basic MOS.  The numbers "00" will be inserted as the sixth and seventh characters when a position does not require an ASI or a Soldier is not qualified for award of an ASI.  ASI codes will be included in permanent change of station orders, records and reports, as required.  DA Pam 611-21 describes authorized ASI codes to include descriptions of positions, qualifications and restrictions. 

   e.  Eighth and Ninth Characters (e.g., 13F3HX3OO) – these are two-letter combinations that identify foreign language requirements and qualifications provided in AR 611-6.  Orders, records and reports will use the letters "OO" when foreign language is not required or a Soldier is not foreign language qualified.

8.  Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214.  The purpose of the separation document is to provide the individual with documentary evidence of his or her military service.  It is important that information entered on the form should be complete and accurate.  Chapter 2 of this regulation, in effect at the time, contains guidance on the preparation of the DD Form 214.  It states in pertinent part:

	a.  Item 11 of the DD Form 214 reflects the primary specialty.  This item contains titles of all MOSs served for at least 1 year and includes for each MOS the number of years and months served.  For an enlisted Soldier, this item also specifies the first five characters of the primary MOS code (MOSC) which includes the three characters of the MOS, the fourth character of skill and grade level in the MOS, and the fifth character of a special qualification identifier (SQI) if applicable or "O" when not applicable.  Any ASIs validated may be entered here or in item 14 (Military Education), if applicable.

	b.  Item 14 reflects service schools, including dates and major courses which were successfully completed.  This entry also includes military sponsored courses completed in civilian schools or colleges during the period covered by the DD Form 214, when prepared.  This information is to assist Soldiers in job placement and counseling.  Training courses for combat skills are not listed.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's MOS as shown on his DD Form 214 should be 13F3HX3OO. He should be issued a new DD Form 215 reflecting this MOS.

2.  The applicant's DA Form 2627 is properly filed.  No further action is required; it should not be removed or transferred to the restricted portion of his OMPF.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR20090000773 dated 11 June 2009.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by further amending his DD Form 214 by showing his MOS in Block 11 as 13F3HX3OO.

2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to removal or transfer of his DA Form(s) 2627.
