THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests removal from his official military personnel file (OMPF) Military Personnel Awards Orders Number 2009-107, issued by the Defense Information Systems Agency (DISA), on 4 August 2009, revoking his award of the Defense Meritorious Service Medal (DMSM).
2. The applicant states
a. Several years ago, he was supposed to transfer on a permanent change of station (PCS) from the White House Communications Agency (WHCA) and he had orders. He was a couple of months from signing out and had started outprocessing but WHCA cancelled his orders and involuntarily extended him because he was in a critically-short position. Unfortunately, they had already completed his PCS award and sent it to the U.S. Army Human Resources Command (HRC) for filing. After cancelling his orders they revoked that PCS award because he was there for another year. In 2010, he was finally able to PCS and WHCA updated that same PCS award and it is now in his file.
b. His concern is for that revocation order. People looking at him for the master sergeant/E-8 (promotion) board will not have the proper context to understand it is there for no negative reason. In fact, the opposite, his unit did not want him to go. Without the proper context the [promotion] board could construe the revocation order as negative in nature. "Why did they take this guy's award away?" Not only could this hurt his chances at promotion, it could adversely impact him in regard to the Army's Qualitative Service/Qualitative Management Programs.
3. The applicant does not provide any evidence.
CONSIDERATION OF EVIDENCE:
1. The applicant's records show he enlisted in the Regular Army on 30 August 1995 and he holds military occupational specialty 94W (Electronic Maintenance Chief).
2. He has served through multiple extensions or reenlistments, in a variety of assignments, and he attained the rank/grade of sergeant first class/E-7 on 1 January 2009.
3. He was assigned to WHCA, a joint element that is serviced (personnel and administration) by DISA, from September 2003 to May 2010. He was reassigned to the 183rd Maintenance Company, Afghanistan, in or around June 2010.
4. On 16 April 2009, DISA published Military Personnel Awards Orders Number 2009-043 awarding the applicant the DMSM for meritorious service from 12 December 2003 to 21 July 2009, by reason of "PCS."
5. On 4 August 2009, DISA published Military Personnel Awards Orders Number 2009-107 revoking Military Personnel Awards Orders Number 2009-043, issued on 16 April 209, awarding the applicant the DMSM for meritorious service from 12 December 2003 to 21 July 2009.
6. The original order (2009-043) awarding him the DMSM (2009-043) is not filed in his OMPF; however, the revocation order (2009-107) is filed in the performance folder of his OMPF.
7. On 15 June 2010, DISA published Military Personnel Awards Orders Number 2010-096 awarding the applicant the DMSM for meritorious service from 22 December 2003 to 21 July 2010. The order is filed in the performance folder of his OMPF.
DISCUSSION AND CONCLUSIONS:
1. The purpose of maintaining the OMPF is to protect the interests of both the U.S. Army and the Soldier. In this regard, the OMPF serves to maintain an unbroken, historical record of a Soldier's service, conduct, duty performance, and evaluation periods, and any corrections to other parts of the OMPF. Once placed in the OMPF, the document becomes a permanent part of that file and will not be removed from or moved to another part of the OMPF unless directed by an appropriate authority.
2. The available evidence indicates the applicant was scheduled to PCS out of WHCA in July 2009. He was recommended for and awarded the DMSM (Orders 2009-043) for service from December 2003 to July 2009. However, it appears his assignment with WHCA was extended by 1 year. As such, the award of the DMSM was revoked by Orders 2009-107. He served his 1-year extension and he was awarded the DMSM (Orders 2010-096) for service from December 2003 to July 2010
3. The existence of a set of orders revoking an award that was issued awarding him the DMSM on his performance folder is a detractor that stands out as soon as his records are reviewed. Since he served an extra year, his orders were subsequently revoked. The original order awarding him the DMSM is not filed on his OMPF. However, the revocation order is filed. There is no harm to the Army or to the Soldier if the revocation order is removed from his OMPF.
