THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that her period of mobilization with the Army Medical Command between 15 January 2012 through 14 August 2012 be shown at item 18 (Remarks) of her DD Form 214 (Certificate of Release or Discharge From Active Duty).

2.  The applicant states her period of mobilization with the Army Medical Command is not properly reflected on her DD Form 214.

3.  The applicant provides copies of a DD Form 214 and four sets of U.S. Army Human Resources Command (HRC) orders dated 4 January 2012, 30 January 2013, 30 January 2012, and 25 July 2012. 

CONSIDERATION OF EVIDENCE:

1.  The applicant, a U.S. Army Reserve (USAR) sergeant first class, enlisted in Regular Army on 22 November 1989 with transfer to the USAR on 22 November 1992.

2.  HRC Orders A-01-201806, dated 30 January 2012, ordered the applicant to active duty under the provisions of Title 10, U.S. Code (USC), section 12301 (D) in support of the national emergency declared under Presidential Proclamation 7463, for a period of 362 days effective 15 January 2012.  Her duty assignment under these orders was Army Medical Command, Pinellas Park, Florida

3.  HRC Orders A-01-201806A01, dated 25 July 2012, changed her end date of active duty from 10 January 2013 to 14 August 2012.

4.  2nd Medical Brigade Orders 12-219-00001, dated 6 August 2012, ordered the applicant to active duty in support of Operation Enduring Freedom for 370 days effective 15 August 2012.  

5.  The applicant's last DD Form 214 of record shows the period of service as from 15 August 2012 through 21 June 2013.  Item 18 of the June 2013 DD Form 214 shows service in Kuwait from 25 August 2012 through 12 May 2013.  

6.  A DD Form 215 (Correction to the DD Form 214), issued on 27 February 2015,  corrected the start date of her period of active duty from 15 August 2012 to 15 January 2012.

7.  On 29 October 2014, the applicant was called to active duty for a period of 331 days, effective 4 November 2014, with an end date of 30 September 2015.

8.  Army Regulation 635-8 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army.  It establishes standardized policy for preparing and distributing the DD Form 214 and states block 18 is to be used for Headquarters Department of the Army mandatory entries when a separate block is not available.  For Reserve Component (RC) Soldiers ordered to active duty, participating in or supporting a contingency operation, and deployed to a foreign country, enter the following statements in 1, 2, and 3, below in succession.  For RC Soldiers ordered to active duty, participating in or supporting a contingency operation, and stationed in Continental United States (CONUS) enter statements in 1 and 3, below:

1. "ORDERED TO ACTIVE DUTY IN SUPPORT OF (OPERATION NAME) PER 10 USC (applicable section)."

2. "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates)."

3. "SOLDIER HAS/HAS NOT COMPLETED PERIOD FOR WHICH ORDERED TO ACTIVE DUTY FOR PURPOSE OF POST–SERVICE BENEFITS AND ENTITLEMENTS."




DISCUSSION AND CONCLUSIONS:

1.  The applicant was called to active duty on 15 January 2012 under Presidential Proclamation 7463.  She appears to have served from 15 January 2012 through 14 August 2012 with the Army Medical Command, Pinellas Park, Florida.  This period of mobilization is not recorded in block 18.  

2.  Upon completion of the above period of service, the applicant was immediately transferred to the 2nd Medical Battalion effective 15 August 2012 and was deployed to Iraq for the period from 25 August 2012 through 12 May 2013.  She was released from active duty on 21 June 2013.  He period of service in Iraq is recorded at block 18 on the DD Form 214.

3.  A DD Form 215 was issued correcting her DD Form 214 to show her total period of continuous active duty as from 15 January 2012 through 21 June 2013.

4.  It would be appropriate include the mandatory entry for her period of CONUS service as follows:

"ORDERED TO ACTIVE DUTY IN SUPPORT OF THE NATIONAL EMERGENCY DECLARED UNDER PRESIDENTIAL PROCLAMATION 7463 PER 10 USC SECTION 12301 (D)."

5.  The mandatory statement "SOLDIER HAS COMPLETED PERIOD FOR WHICH ORDERED TO ACTIVE DUTY FOR PURPOSE OF POST–SERVICE BENEFITS AND ENTITLEMENTS" was omitted from the DD Form 214.  It would be appropriate to include this statement at this time.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the following statements to the applicant's 21 June 2013 DD Form 214, at block 18:

"ORDERED TO ACTIVE DUTY IN SUPPORT OF THE NATIONAL EMERGENCY DECLARED UNDER PRESIDENTIAL PROCLAMATION 7463 PER 10 USC SECTION 12301 (D)"

"SOLDIER HAS COMPLETED PERIOD FOR WHICH ORDERED TO ACTIVE DUTY FOR PURPOSE OF POST–SERVICE BENEFITS AND ENTITLEMENTS"
