THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, correction of Unit Order Number 105, issued by Headquarters Detachment, U.S. Army Pusan Base Command on                   22 November 1968, to show his social security number (SSN) as "566-XX-XXXX" instead of "556-XX-XXXX."

2.  The applicant states:

* his SSN is incorrect on the subject orders
* he received his service records from the National Personnel Records Center (NPRC) and a temporary duty (TDY) order was not enclosed
* he was assigned to carry two boxed Geiger counters with two armed escorts to the demilitarized zone (DMZ)
* these Geiger counters were to be delivered by him, since he was a Chemical, Biological, and Radiological (CBR) team member
* he stayed overnight at Camp Casey, in January 1969; however, after forty-some odd years, he doesn't remember the names of the escorts

3.  The applicant provides a copy of Unit Order Number 105.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  On 30 December 1966, the applicant completed a DD Form 398 (Statement of Personal History) wherein he listed his SSN as "566-XX-XXXX."

3.  On 11 January 1967, the applicant enlisted in the Regular Army.  His enlistment documents identify him by his service number.

4.  Unit Order Number 105, issued by Headquarters Detachment, U.S. Army Pusan Base Command on 22 November 1968, appointed the applicant and several other unit members to CBR Alpha Team, effective 17 October 1968.  These orders show the applicant's SSN as "556-XX-XXXX."

5.  On 17 August 1969, he was honorably released from active duty and transferred to the U.S. Army Reserve.  Item 3 (SSN) of his DD Form 214 shows his SSN as "566-XX-XXXX."

6.  The vast majority of documents contained within his military personnel records jacket (MPRJ) identify him by the SSN contained on his DD Form 214; however, the disputed SSN does appear on a small number of documents in his MPRJ.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends on the subject Unit Order Number 105 should be corrected to show his SSN as "566-XX-XXXX."

2.  The evidence shows he enlisted in the Regular Army on 11 January 1967, and at the time of his enlistment his SSN was represented as "566-XX-XXXX."  This SSN appears on most of the official documents contained within his MPRJ, including his DD Form 214.  It appears this is his correct SSN, since it was the first SSN used to represent him, and it is the SSN that most often identified him throughout his period of active military service. 

3.  It appears the SSN shown on the subject Unit Order Number 105 is incorrect; therefore, it would be appropriate to correct this order to show his SSN as it is shown on his DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending Unit Order Number 105, issued by Headquarters Detachment, U.S. Army Pusan Base Command on 22 November 1968, to delete the SSN as shown and replace it with the SSN that is shown on his DD Form 214.
