THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his Social Security Number (SSN) as xx8-xx-xxxx instead of xx6-xx-xxxx.

2.  The applicant states his DD Form 214 does not have his correct SSN.

3.  The applicant provides:

* his DD Form 214
* his Social Security card

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  The applicant’s DD Form 398 (Statement of Personal History), prepared on
2 September 1966, shows his SSN as xx8-xx-xxxx.  He was inducted into the Army of the United States on 6 September 1966.  

3.  The applicant’s Military Personnel Records Jacket (MPRJ) contains the following documents that show his SSN as xx8-xx-xxxx:

* DA Form 41 (Record of Emergency Data), dated 9 September 1967
* DA Form 2349 (Military Pay Voucher) for the pay period 1-31 July 1968
* Special Orders Number 132, issued by Headquarters, 28th Transportation Battalion, dated 18 June 1968
* Special Orders Number 230, issued by Headquarters, U.S. Army Personnel Center, Fort Dix, dated 17 August 1968

4.  On 17 August 1968, the applicant was honorably released from active duty at the expiration of his term of service.  He completed 1 year, 11 months, and
12 days of total active service.  Item 3 (SSN) of the DD Form 214 he was issued at the time shows of his SSN as xx6-xx-xxxx.

5.  The applicant provided his Social Security card that shows his SSN as 
xx8-xx-xxxx.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's DD Form 214 shows his SSN as xx6-xx-xxxx. The applicant's Social Security card and documents contained in his MPRJ confirm his SSN is xx8-xx-xxxx.  It appears an administrative error occurred during the preparation of his DD Form 214 when his SSN was recorded.

2.  In view of the foregoing, the applicant's DD Form 214 should be corrected to show his SSN as shown on his DD Form 398.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by replacing the SSN on his DD Form 214 with the SSN on his DD Form 398.
