		IN THE CASE OF:

		BOARD DATE:	 3 February 2015

		DOCKET NUMBER:  AR20140011506

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show his dates of service as being from 2007 to 2014 (no days or months specified) instead of the current period of 22 January 2008 to 18 December 2013.

2. The applicant states the dates shown are not correct.

3. The applicant provides no additional evidence.

CONSIDERATION OF EVIDENCE:

1. The applicant's DD Form 4 (Enlistment/Reenlistment Document - Armed Forces of the United States) shows he enlisted in the U.S. Army Reserve (USAR) Delayed Entry Program (DEP) on 3 January 2008. This form also shows he was obligated to enlist in the Regular Army on 22 January 2008.

2. His record contains a DD Form 1966 (Record of Military Processing - Armed Forces of the United States) which shows an enlistment in the DEP on 3 January 2008. It also indicates a date of enlistment in the Regular Army of 22 January 2008.

3. His record also contains a DA Form 3286 (Statement of Enlistment United States Army Enlistment Program U.S. Army DEP) which was signed on 3 January 2008, and shows he is to enter the Regular Army on 22 January 2008.

4. His record contains an Enlisted Record Brief (ERB) which was created upon his entry on active duty and shows both his Basic Active Service Date (BASD) and Pay Entry Base Date (PEBD) as 22 January 2008.

5. His record contains a DD Form 4 which shows he reenlisted in the Regular Army on 9 November 2010. In item 7 (Previous Military Service upon Enlistment/Reenlistment) it shows total active military service of 2 years, 9 months and 17 days. This term is consistent with the BASD and PEBD dates on his ERB.

6. Orders 347-0114, issued by U.S. Army Installation Management Command, Headquarters, U.S. Army Garrison, Fort Bliss, on 13 December 2013, directs the applicant to report on 18 December 2010 to the transition center for transition processing. Date of discharge shown is 18 December 2013.

7. On 18 December 2013, he received a general discharge under honorable conditions. His DD Form 214 shows his total net active service as 5 years, 10 months, and 27 days.

8. Army Regulation 635-8 (Separation Processing and Documents) prescribes policy and procedural guidance for the preparation of the DD Form 214. It states, in pertinent part, source document will include:

* ERB
* separation order
* other documents authorized for filing in the Official Military Personnel File

DISCUSSION AND CONCLUSIONS:

1. The applicant contends his dates of service should be shown as being from 2007 to 2014 (no days or months specified) rather than what is currently reflected on enlistment contracts and his DD Form 214. In making this contention, however, he offers no evidence.

2. All documents in his personnel record consistently show his BASD and PEBD as 22 January 2008. The record is void of any reference to 2007. Additionally, both his separation order and DD Form 214 show his separation date as 18 December 2013. There is nothing indicating his term of service ended in 2014.

    The DD Form 214 issued to the applicant on the date of his REFRAD for retirement indicates that he entered active duty on that particular period of service on 5 October 1984. Based on the regulatory guidance for the preparation of the separation documents and given the applicant was not issued a DD Form 214 for his first enlistment, from 3 November 1981 through 4 October 1984, the Board concludes that several entries contained in Item 12 (Record of Service) of his 31 March 2002 DD Form 214...
