THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Report of Separation from the Armed Forces of the United States) to show the Presidential Unit Citation.  

2.  The applicant states the award was not entered on his DD Form 214 at the time he was discharged.  

3.  The applicant provides a memorandum from the Secretary of the Navy, dated 7 November 2013, subject:  Inclusion of Units in a Previously Awarded Presidential Unit Citation. 

CONSIDERATION OF EVIDENCE:

1.  The applicant's complete military records are not available for review.  A fire destroyed approximately 18 million service members' records at the National Personnel Records Center in 1973.  It is believed that his records were lost or destroyed in that fire.  However, there are sufficient documents remaining in a reconstructed record for the Board to conduct a fair and impartial review of this case.

2.  His DD Form 214, as amended by a DD Form 215 (Correction to DD Form 214), shows:

	a.  he enlisted in the Regular Army on 1 March 1949;

	b.  he served 10 months and 18 days of foreign and/or sea service;

	c.  he was awarded or authorized the Korean Service Medal with four bronze service stars, United Nations Service Medal, and the Republic of Korea Presidential Unit Citation; and

	d.  he was honorably discharged on 30 November 1951.

3.  His available records include a certified copy of a certificate of service presented to him by the Commander, 92nd Armored Field Artillery (AFA) Battalion.  The certificate confirms he served with 92nd AFA Battalion in combat operations in Korea from 20 September 1950 through 10 June 1951.

4.  His available records also include a narrative for the Presidential Unit Citation and a Presidential Unit Citation Certificate, dated 5 February 2002, indicating the 92nd AFA Battalion was awarded the Presidential Unit Citation for service during the period 27 November-11 December 1950.  

5.  He provided a memorandum from the Secretary of the Navy, dated 
7 November 2013, subject:  Inclusion of Units in a Previously Awarded Presidential Unit Citation, in which the Secretary of the Navy approved the addition of the 92nd AFA Battalion to the list of units authorized the Presidential Unit Citation previously awarded to the First Marine Division (Reinforced) for actions in Korea during the periods 21-26 April 1951, 16 May-30 June 1951, and 11-25 September 1951.

6.  Army Regulation 600-8-22 (Military Awards) states:

	a.  The National Defense Service Medal is awarded for honorable active service for any period between 27 July 1950 and 27 July 1954, 1 January 1961 and 14 August 1974, 2 August 1990 and 30 November 1995, and 11 September 2001 and a date to be determined.  

	b.  The Republic of Korea War Service Medal is awarded to members of the U.S. Armed Forces who served in Korea and adjacent waters between 25 June 1950 and 27 July 1953.  The service must have been performed, in part, while on permanent assignment or on temporary duty for 30 consecutive or 60 non-consecutive days within the territorial limits of Korea or the waters immediately adjacent thereto.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's request for correction of his DD Form 214 to show the Presidential Unit Citation was carefully considered.  

2.  The evidence shows he served with the 92nd AFA Battalion from 
20 September 1950 to 10 June 1951.  The 92nd AFA Battalion was awarded the Presidential Unit Citation for service during the period 27 November through     11 December 1950.  

3.  Additionally, on 7 November 2013, the Secretary of the Navy awarded the 92nd AFA Battalion the Presidential Unit Citation for service during the periods 21-26 April 1951, 16 May-30 June 1951, and 11-25 September 1951.  

4.  Therefore, his DD Form 214 should be corrected to show the Presidential Unit Citation (2nd Award).  

5.  Based on his service in Korea, he is authorized the Republic of Korea War Service Medal and correction of his DD Form 214 to show this award.  

6.  Based on his period of honorable service from 1 March 1949 to 30 November 1951, he is also authorized the National Defense Service Medal and its addition to his DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by 



amending his DD Form 214 by adding the Presidential Unit Citation (2nd Award), the Republic of Korea War Service Medal, and the National Defense Service Medal.
