THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of an earlier request for award of the Republic of Korea Presidential Unit Citation (ROKPUC) for the period 19 September 1950 to June 1952. 2. The applicant states, in effect, that he was assigned to the 1st Field Artillery Observation Battalion in November 1949 after basic training and was deployed with this unit to Korea in August 1950. He remained a part of this unit until he rotated back to the United States in September 1951 except for the period he was hospitalized. He was not aware that he was entitled to this specific award until June 2008 when it was noted in an association unit history report. 3. The applicant provides two unit rosters and transfer orders in support of his request for reconsideration. CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20090003935 on 26 August 2009. 2. The applicant provides two Headquarters, 1st Artillery Observation Battalion unit rosters, dated 1 October 1950 and 31 December 1950. His name appears on these rosters. 3. The applicant also provides Headquarters, 1st Artillery Observation Battalion transfer orders, dated 8 December 1950, which show he was transferred from Battery C to Headquarters Battery. 4. The applicant's submissions are new evidence which will be considered by the Board. 5. The applicant’s military records are not available to the Board for review. A fire destroyed approximately 18 million service members’ records at the National Personnel Records Center in 1973. It is believed that the applicant’s records were lost or destroyed in that fire. However, there was sufficient evidence for the Board to conduct a fair and impartial review of this case. The primary record available to this Board is the applicant’s DD Form 214. 6. The applicant enlisted in the Regular Army on 3 August 1949 and trained as a field artilleryman. His military transcript record shows he served in Korea from 25 August 1950 to 7 October 1951 and was honorably discharged on 26 September 1952. 7. The applicant's DD Form 214 (Report of Separation from the Armed Forces of the United State) shows the Good Conduct Medal, the United Nations Service Medal, and the Korean Service Medal with six bronze service stars as authorized awards. 8. Department of the Army Pamphlet 672-1 (Unit Citation and Campaign Participation Credit Register), shows, among other information, unit awards and citations authorized for units which served during World War II and Korea. This document shows the 1st Field Artillery Observation Battalion was cited for the ROKPUC for the period 19 September 1950 to 31 July 1952 based on Department of the Army General Orders (DAGO) Number 41, dated 1955. 9. Department of the Army Pamphlet 672-1 also shows the 1st Field Artillery Observation Battalion was cited for the Meritorious Unit Commendation for the period 29 August 1950 to 30 April 1952 based on DAGO Number 10, dated 1953. 10. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the National Defense Service Medal is awarded for honorable active service for any period between 27 July 1950 and 27 July 1954, 1 January 1961 and 14 August 1974, 2 August 1990 and 30 November 1995, and 11 September 2001 and a date to be determined. 11. Army Regulation 600-8-22 states that the Republic of Korea War Service Medal is awarded to members of the U.S. Armed Forces who served in Korea and adjacent waters between 25 June 1950 and 27 July 1953. The service prescribed must have been performed as follows: a. while on permanent assignment, b. while on temporary duty within the territorial limits of Korea or on waters immediately adjacent thereto for 30 consecutive days or 60 nonconsecutive days, or c. while as crew members of aircraft in aerial flight over Korea participating in actual combat operations or in support of combat operations. DISCUSSION AND CONCLUSIONS: 1. Evidence of record shows the applicant was assigned to the 1st Field Artillery Observation Battalion during his assignment in Korea. This unit was cited for the ROKPUC and the Meritorious Unit Commendation while the applicant was assigned to the unit. Therefore, his DD Form 214 should be corrected to show these unit citations. 2. The applicant served a period of qualifying service for award of the National Defense Service Medal and the Republic of Korea War Service Medal. Therefore, his DD Form 214 should be corrected to show these medals.
