IN THE CASE OF:
BOARD DATE: 27 May 2014
DOCKET NUMBER: AR20140007250
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, his Home of Record (HOR) be listed as "Clermont" vice "Clemont."
2. The applicant states his HOR was incorrectly spelled when he processed through the Military Entrance Processing Station (MEPS).
3. The applicant provides a copy of his driver's license.
CONSIDERATION OF EVIDENCE:
1. Prior to the applicant's appointment as a Regular Army officer, Orders Number A-02-104150, issued by the U.S. Army Human Resources Command (HRC) on 28 February 2011, listed his HOR as "Clemont." He was later appointed on 23 May 2011.
2. His Officer Record Brief shows his HOR as "Florida" and his mailing address lists "Clemont, Florida."
3. His record does not contain and he did not provide any of the paperwork he completed at MEPS prior to his appointment.
4. The applicant's record contains several memoranda dated between 11 September and 1 November 2013 showing he requested an unqualified resignation and separation from military service effective 28 May 2014. His chain of command recommended approval.
5. His record did not contain separation orders or a DD Form 214 (Certificate of Release or Discharge from Active Duty).
6. He provided a copy of his driver's license showing the same street address listed in Orders Number A-02-104150. However, the location was listed as "Clermont."
7. A search of the internet shows a listing for "Clermont, Florida." There is no listing for "Clemont, Florida."
8. The Joint Federal Travel Regulation provides that the HOR is the place recorded as the home of the individual at the time of enlistment or induction. There is no authority to change the HOR as officially recorded at time of entry into military service. However, there is authority to correct a HOR if erroneously entered on the records at that time and then only for travel and transportation purposes. Correction of the HOR must be based on evidence that a bona fide error was made and the HOR as corrected must have been the actual home of the individual at the time of entry into the relevant period of service. It may not be a place selected for the convenience of the Soldier.
DISCUSSION AND CONCLUSIONS:
1. It appears that the applicant's street address was correctly listed in his record; however, the town/county of "Clermont" was inadvertently entered as "Clemont." This appears to be a simple typographical error.
2. Therefore, based on the foregoing, any military record listing his HOR should be corrected to show his town/county as "Clermont."
BOARD VOTE:
____X____ ___X_____ _____X___ GRANT FULL RELIEF

The applicant states, in effect, that his home of record is listed as Alabama and should have been Florida and that he needs this error corrected for tax purposes. The evidence shows that the applicant's place of enlistment, on 26 January 1965, was listed as "Montgomery, Alabama." There is no evidence to show that an error was made in recording his HOR at the time of his separation; therefore, there is no basis to correct his records as requested.
