THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

CONSIDERATION OF ADDITIONAL EVIDENCE:

22.  On 28 January 2014, new information was received from the applicant in regard to the decision of the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20130013003, dated 26 September 2013.

23.  The evidence submitted consists of an email, dated 28 January 2014, from the applicant which states, in effect, per Docket Number AR20130013003, the following documents should be removed from his Army Military Human Resource Record (AMHRR):

* Performance folder - Evaluation Report Appeal Decision by the Enlisted Special Review Board (ESRB), dated 5 December 2010
* Restricted folder - ABCMR Decision and Record of Proceedings 
* Restricted folder - Evaluation Report Appeal Decision by the ESRB 

ADDITIONAL DISCUSSION AND CONCLUSIONS:

7.  At the time of the decision of the ABCMR in Docket Number AR20130013003, dated 26 September 2013, it was the intent of the ABCMR to make the applicant’s record as administratively correct as it should properly have been at the time.



8.  The ABCMR's decision in Docket Number AR20130013003 failed to state all related documents pertaining to the applicant's Noncommissioned Officer 
Evaluation Report (NCOER) for the period 1 September 2010 through 31 August 2011, including ESRB documentation, should be removed out of all folders in his AMHRR.

BOARD DETERMINATION/RECOMMENDATION:

3.  The Board determined the evidence presented was sufficient to warrant an amendment of the decision of the Army Board for Correction of Military Records set forth in Docket Number AR20130013003, dated 26 September 2013, by amending paragraph 1 of the BOARD DETERMINATION/RECOMMENDATION to read:

1. The Board determined the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by expunging the NCOER for the period 1 September 2010 through 31 August 2011 from his AMHRR, replacing it with a nonrated statement, and removing all related documents to included the ESRB action out of all folders in his AMHRR.

4.  As a result of this correction, the following documents should be removed from his AMHRR:

* Performance folder - Evaluation Report Appeal Decision by the ESRB, dated 5 December 2010


* Restricted folder - ABCMR Decision and Record of Proceedings 
* Restricted folder - Evaluation Report Appeal Decision by the ESRB
