THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his foreign service.

2.  The applicant states he deployed with his unit to Iraq in May 2009.

3.  The applicant provides no additional evidence.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 13 September 2007.  He completed training as a Bradley Fighting Vehicle Maintainer

2.  Information obtained from the Defense Finance and Accounting Service (DFAS) reveals that per the applicant's master military pay account, he received hostile fire/imminent danger pay for service in Kuwait/Iraq from 5 May 2009 through 25 April 2010.

3.  The applicant was released from active duty (REFRAD) on 6 March 2011 upon completion of his required active service.  Item 12f (Foreign Service) on his DD Form 214 shows he had "0000 Years, 00 Months, and 00 Days" of foreign service.

4.  Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or authorized) of his DD Form 214 shows the following awards:

* Army Good Conduct Medal
* National Defense Service Medal
* Global War on Terrorism Service Medal
* Army Service Ribbon

5.  Army Regulation 635-5 (Separation Documents) then in effect, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  It established standardized policy for the preparation of the DD Form 214.  It stated the DD Form 214 is a synopsis of the Soldier’s most recent period of continuous active duty.  It provided a brief, clear-cut record of active Army service at the time of REFRAD, retirement or discharge.  It stated:

	a.  In item 12f – From the Enlisted Record Brief (ERB), enter the total amount of foreign service completed during the period covered by the DD Form 214.

	b.  Item 13 – Decorations medals, badges, citations and campaign ribbons will be entered from information recorded on the ERB.

	c.  In item 18 (Remarks) – For an active duty Soldier deployed with his or her unit during their continuous period of active service, the statement "SERVICE IN (NAME OF COUNTRY DEPOLYED) FROM YYYYMMDD-YYYYMMDD)" will be entered.  

6.  Army Regulation 600-8-22 (Military Awards) states:

	a.  The Iraq Campaign Medal is awarded to members who have served in direct support of Operation Iraqi Freedom (OIF).  The area of eligibility encompasses all the land area of the country of Iraq, the contiguous water area out to 12 nautical miles, and all air spaces above the land area of Iraq and above the contiguous water area out to 12 nautical miles.  The Iraq Campaign Medal period of eligibility is on or after 19 March 2003 through 31 December 2011.  A bronze service star is authorized for wear with this medal for participation in each credited campaign.  The applicant participated in the Iraqi Sovereignty Campaign which extended from 1 January 2009 through 31 August 2010.

	b.  The Overseas Service Ribbon was established by the Secretary of the Army on 10 April 1981.  Effective 1 August 1981, all members of the Active Army, Army National Guard, and Army Reserve in an active Reserve status are eligible for the award for successful completion of overseas tours.  


DISCUSSION AND CONCLUSIONS:

1.  The applicant's contentions have been noted.

2.  The available evidence shows that the applicant served in Iraq from 5 May 2009 through 25 April 2010.  His DD Form 214 should be amended to show his foreign service.

3.  As a related issue, his DD Form 214 should also be amended to show the Iraq Campaign Medal and the Overseas Service Ribbon.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 as follows:

* Item 12f – 11 Months, 21 Days
* Item 13 – adding "Iraq Campaign Medal with one bronze service star" and "Overseas Service Ribbon"
* Item 18 – adding "SERVICE IN KUWAIT/IRAQ FROM 20090505-20100425"
