BOARD DATE: 15 May 2014
DOCKET NUMBER: AR20130013797
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Report of Separation from Active Duty) to show his first name as "Lawrence."
2. The applicant states his first name was changed by his mother but never recorded. It has since been changed with the Bureau of Vital Statistics.
3. The applicant provides copies of his birth certificate, Affidavit of Correction to Birth Record to South Carolina Department of Health and Environmental Control, and social security card.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant enlisted in the Regular Army on 27 August 1973. He was honorably relieved from active duty on 20 August 1976.
3. All of his military service records show he served under the first name "Leonard." The applicant signed his DD Form 214 using the first name "Leonard."
4. There is no evidence in the available records that shows he performed military service under the first name "Lawrence."
5. The applicant provided his Affidavit of Correction to Birth Record to South Carolina Department of Health and Environmental Control, and social security card which show his first name as "Lawrence."
DISCUSSION AND CONCLUSIONS:
1. The applicant used the first name "Leonard" throughout his military service and this name is properly recorded on his DD Form 214.
2. For historical purposes, the Army has an interest in maintaining the integrity of its records. The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created. In the absence of a showing of material error or injustice, there is a reluctance to recommend that those records be changed. While it is understandable that the applicant desires to record the name he now uses on his DD Form 214, there is not a sufficiently compelling reason for compromising the integrity of his DD Form 214.
3. The applicant is advised that a copy of this decisional document will be filed in his military records. This should serve to clarify any questions or confusion regarding the difference between the name recorded on his DD Form 214 and the name he now uses.
BOARD VOTE:
________ ________ ________ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
_x____ __x______ ____x____ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

Application for correction of military records (with supporting documents provided, if any). The applicant's DD Form 47 (Record of Induction) does not contain any entries or information concerning an SSN. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show the spelling of his last name as "Hug" instead of "Hugg." This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. His DD Form 47 (Record of Induction) shows his last...

Application for correction of military records (with supporting documents provided, if any). The applicant provided several documents which show his first name as Albert; however, these documents are insufficient to change his first name on his DD Form 214. He has not shown that the Army's records are in error as all official documents contained in his available service personnel and medical records show he was recognized by and served under the name of Abner.

The applicant requests correction of his DD Form 214 (Report of Separation from Active Duty) to show his date of birth (DOB) as 3 April 19XX. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. Although the State of South Carolina documentation provided by the applicant shows his DOB as 3...

Application for correction of military records (with supporting documents provided, if any). Three documents in the applicant's records list the applicant's SSN as that shown on his DD Form 214. Since half the documents in the applicant's records which reflect an SSN have the SSN shown on the applicant's social security card, it is evident that this is his correct SSN and it would now be proper to change it on his DD Form 214.
ARMY | BCMR | CY2014 | 20140015077
The applicant requests that her deceased husband's, a former service member's (FSM), date of birth (DOB) on his DD Form 214 (Report of Separation from the Armed Forces of the United States), dated 12 October 1954, be corrected to show XX November 1930 instead of XX June 1930. The FSM's DOB would have been verified at the time of his induction; however, those records are not available. The only justification for changing the FSM's DOB on his DD Form 214 would be if it was not consistent...

The applicant requests, in effect, correction of his military service records to show his correct date of birth (DOB). The applicant contends, in effect, that the DOB recorded in his military personnel records should be corrected to show he was born on # February 19#6. The evidence of record shows that the applicant's military personnel records consistently show his DOB as # February 19#7.
ARMY | BCMR | CY2013 | 20130014200
The applicant requests correction of his records to show his place of birth as Orangeburg, South Carolina and the first three digits of his Social Security Number (SSN) as 210, not 204. His DD Form 47 (Record of Induction) shows his place of birth as Orangeburg, SC. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending the applicant's DD Form 214 to show Orangeburg, SC, as his place of birth.
ARMY | BCMR | CY2013 | 20130004903
The applicant requests correction of his DD Form 214 (Report of Separation from Active Duty) to show his date of birth as 23 October 1956. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. A thorough review of all documents contained in his available military personnel records, many of...
