THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests the fourth and fifth digits of his social security number (SSN) on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) with an effective date of 10 July 1969 be changed to "92."
2. The applicant states the SSN shown on his DD Form 214 is incorrect.
3. The applicant provides his:
* DD Form 214
* orders for release from active duty
* social security card
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. On 6 December 1967, he was inducted into the Army of the United States. He was assigned an Army service number (ASN) as the primary source of identification. Item 1 (Last Name - First Name - Middle Name) of his
DD Form 47 (Record of Induction) contains an entry showing his SSN with the fourth and fifth digits as "92."
3. His orders for induction for active duty, dated 6 December 1967, show his SSN with the fourth and fifth digits as "92."
4. His Military Personnel Records Jacket (MPRJ) contains a DD Form 398 (Statement of Personal History), dated 14 July 1968. This form shows he entered his SSN with the fourth and fifth digits as "92."
5. On 10 July 1969, he was released from active duty. Item 3 (Social Security Number) of his DD Form 214 shows his SSN with the fourth and fifth digits as "19."
6. He provided his social security card that shows his SSN with the fourth and fifth digits as "92."
7. During the period the applicant served on active duty, Soldiers were identified primarily by their ASN. The Army discontinued using the ASN as an identifier and began using the SSN on 1 July 1969.
DISCUSSION AND CONCLUSIONS:
1. During the period of the applicant's service, Soldiers were identified by their ASN. The Army did not start using SSNs as the primary source of identification until 1 July 1969. Therefore, an error in his SSN could easily have gone undetected.
2. The applicant's DD Form 47, induction orders, DD Form 398, and his social security card all show his SSN with the fourth and fifth digits as "92." Therefore, there is sufficient evidence to correct his DD Form 214 to show his SSN as shown on these documents.
