THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Army Commendation Medal (ARCOM) and Army Good Conduct Medal (AGCM) (2nd Award).

2.  He states he received his DD Form 214 prior to receiving the ARCOM from his final unit.  His expiration of term of service date fell on his 6-year service anniversary making him eligible for the AGCM (2nd Award).

3.  He provides a DA Form 638 (Recommendation for Award) and an ARCOM Certificate.

CONSIDERATION OF EVIDENCE:

1.  On 4 January 2007, the applicant enlisted in the Regular Army for a period of 6 years.

2.  On 15 February 2010, Headquarters and Headquarters Company, 201st Battlefield Surveillance Brigade, issued Orders 046-009 announcing award of the AGCM (1st Award) to him for the period 4 January 2007 to 3 January 2010.

3.  His records contain an ARCOM Certificate, dated 22 October 2012, showing Permanent Order Number 296-005 issued by the 201st Battlefield Surveillance Brigade awarded him the ARCOM for service from 15 October 2008 to 3 January 2013.

4.  On 3 January 2013, he was honorably released from active duty after completing 6 years of net active service.  His DD Form 214 shows he was awarded the AGCM.  It does not show the ARCOM.

5.  Section III (Service Data) of his Enlisted Record Brief shows his next AGCM eligibility date as 3 January 2013.  Section III also shows he was promoted to sergeant (SGT)/E-5 effective 1 November 2010.

6.  His records are void of documentation showing he was the subject of disciplinary action during his military service.

7.  Army Regulation 600-8-22 (Military Awards) states the AGCM is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service.  This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service.  Although there is no automatic entitlement to the AGCM, disqualification must be justified.

DISCUSSION AND CONCLUSIONS:

1.  Permanent orders awarded the applicant the ARCOM.  Therefore, he is entitled to correction of his DD Form 214 to show this award.

2.  He was awarded the AGCM (1st Award) for the period 4 January 2007 to 3 January 2010 and his records show he completed a second 3-year period of qualifying service for award of the AGCM from 4 January 2010 to 3 January 2013.  There is no evidence in his records that would justify his disqualification for the AGCM (2nd Award) and it appears that an administrative error occurred resulting in the omission of award of a second AGCM.  Therefore, it would be appropriate at this time to award him the AGCM (2nd Award) for the period 4 January 2010 to 3 January 2013 and to correct his DD Form 214 to show this award.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a.  awarding him the AGCM (2nd Award) for the period 4 January 2010 to 3 January 2013 and

	b.  amending his DD Form 214 as follows:

* deleting award of the AGCM
* adding award of the ARCOM and AGCM (2nd Award)
