THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, correction of her records to show her revised Army Services Vocational Aptitude Battery (ASVAB) test scores. 

2.  The applicant states:

	a.  Her ASVAB re-test score does not appear on her DA Form 2-1 (Personnel Qualification Record - Part II) and Enlisted Record Brief (ERB)).  She is in the process of trying to enter the Guard.  Her goal is to get accepted into the program and attend Officer Candidate School in July.  She spoke with a recruiter on 5 March 2013 and when he pulled her information up in the system, he told her that she would need to raise her ASVAB scores to obtain certain jobs that she is interested in to qualify for the program.  She told the recruiter that she retook the ASVAB test while on active duty and that’s when he told her that the re-test is not showing up in the system/on the Reenlistment Eligibility Data Display (REDD) report.

	b.  She worked very hard to raise her score prior to getting out of the military in September of 2002 to have better reenlistment options.  The Army sent her to a class in which she studied hard every day for about 3 to 4 weeks.  Through that class, she was able to obtain her desired score - a General Technical (GT) score of 110.  Now that she is talking to a recruiter, she really needs that GT score of 110 (that she worked so hard for) reflected on her DA Form 2-1 and ERB so she can come back in to the military.  The recruiter did say that he can accept a copy of her DA Form 2-1 or ERB showing her updated scores. 
	c.  She searched for the re-test information at home on 5 March 2013 and could not find it.  The copies she found were dated prior to the re-test.  However, she does have her original re-test results and will enclose a copy to have this injustice/omission updated appropriately as she is currently not in a unit to have the correction made.  She is not really sure why this information is not in the system.  She believes that it could already be updated on her DA Form 2-1 or ERB in her official military record and if so she would like a copy of it to present to recruiters and have the Board update the information in the appropriate systems so that she can move forward with re-enlisting.  She would like this update to be made if it does not show on her latest DA Form 2-1 or ERB on record. She hopes this is an easy fix. 

3.  The applicant provides:

* ASVAB Worksheet for Computing Scores
* DA Form 2A (Personnel Qualification Record - Part I)
* DA Form 2-1

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  The applicant's records show she enlisted in the Regular Army on 24 September 1998 and she held military occupational specialty 75H (Personnel Services Specialist).  

3.  Her DA Form 2-1 shows in item 8 (Aptitude Area Score) a GT score of 88.  It also shows she retested on “16 June 1998” and her GT score was listed as 110. 

4.  She was honorably released from active duty on 23 September 2002.  Her 
DD Form 214 (Certificate of Release or Discharge from Active Duty) shows she 

completed 4 years of active service and she was assigned a Reentry (RE) Code of "1." 

5.  She enlisted in the Army National Guard (ARNG) on 28 June 2002.  She was honorably separated from the ARNG on 15 June 2006.  Her National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service) shows she was assigned an RE code of "1."

6.  She provides a printout which shows she tested/retook her ASVAB test at Fort Stewart, GA, on 26 October 2001 and attained a GT score of 110.   

7.  Army Regulation 600-200 (Enlisted Personnel Management System), in effect at the time, governed the preparation of and the various entries on the DA Form 2-1.  Item 9 lists the aptitude area scores.  A DA Form 2-1 provides a record of an individual's personnel management qualifications such as grade, skills, physical limitations, and assignment history and it is used primarily by personnel managers at unit level to support the Army’s personnel life-cycle function of sustainment.

8.  Army Regulation 600-8-104 (Army Military Human Resource Record (AMHRR) Management) prescribes the policies and mandated operating tasks for the AMHRR, previously known as the official military personnel file.  The ERB is an automated record of personnel management qualifications and provides some duplication, in the form of data, of information recorded in the Soldier's OMPF.  The ERB is created, maintained, and updated while the Soldier is on active duty.  Upon separation from active duty, the ERB is no longer maintained or updated.

9.  U.S. Military Entrance Processing Command Regulation 601-23 states upon check-in of all prior military service applicants, the Military Entrance Processing Station (MEPS) will obtain one of the following documents before processing: 
DD Form 214 Member or Service Copy with Special Additional Information Blocks 23 - 30, DD Form 215 (Correction to DD Form 214), NGB Form 22 (Report of Separation and Record of Service) or the REDD Level 2 printout.  

	a.  The REDD is an automated printout received from the Defense Management Data Center (DMDC) that duplicates the entries on the DD Forms 214/215 and NGB Form 22.  It is similar to the prior service (PS) check currently received nightly from DMDC. 


	b.  By providing the MEPS a signed and dated REDD printout, the Recruiting Service Liaison/Guidance Counselor attests that: 

* Despite concerted efforts, the preferred PS documents cannot be located or obtained
* The printout is an accurate capture of the Level 2 screen shot, including PS Components, active duty periods, and character of service section
* The printout has reference to all periods of PS in the Personnel Loss Data
* A clear explanation of all Inter-service Reenlistment Eligibility codes, Inter- service Separation Codes, and RE codes as defined by  Service regulations is recorded on the bottom of the printout

DISCUSSION AND CONCLUSIONS:

1.  The DA Form 2-1 provides a record of individual personnel management qualifications such as grade, skills, physical limitations, and assignment history and is used primarily by personnel managers at unit level to support the Army’s personnel life-cycle function of sustainment.  This form is now obsolete and has been replaced with the ERB. 

2.  The ERB is an automated record of a Soldier's personnel management qualifications in the form of data.  The ERB is not maintained or updated subsequent to a Soldier's separation from active duty.  Therefore, the applicant is not entitled to correction of her ERB.  However, if the applicant reenters the Active Army, a new ERB will be generated and may capture her ASVAB/GT scores. 

3.  Further, the applicant should show her ASVAB Worksheet for Computing Scores and this Record of Proceedings to her recruiting officials as verification that her GT retest score is 110.
