		IN THE CASE OF:

		BOARD DATE: 14 November 2013

		DOCKET NUMBER: AR20130004745

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show in:

* item 12f (Foreign Service) he served a total of 9 months and 2 days of foreign service
* item 18 (Remarks) he deployed to Afghanistan from 21 March to 12 July 2010

2. He states he was deployed twice to Afghanistan with the first deployment from 21 March to 12 July 2010 and the second deployment from 21 January to 21 May 2011. The first deployment was omitted from his DD Form 214, but it is listed on his Enlisted Record Brief (ERB).

3. He provides his DD Form 214 and ERB.

CONSIDERATION OF EVIDENCE:

1. The applicant enlisted in the Regular Army on 26 February 2008.

2. He provided his ERB, dated 9 December 2011, that indicates he was deployed to Afghanistan from 21 March to 12 July 2010 (a period of 3 months and 22 days) and 21 January to 21 May 2011 (a period of 4 months and 1 day).

3. On 25 February 2012, he was honorably released from active duty at the completion of his required active service and he was transferred to the U.S. Army Reserve (USAR) Control Group (Reinforcement) to complete his remaining service obligation. He completed 4 years of creditable active service. His
DD Form 214 shows in:

	a. item 12f (Foreign Service) he completed 4 months and 1 day of foreign service.

	b. item 18 he served in Afghanistan from 21 January to 21 May 2011.

4. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for preparation of the DD Form 214. It states for:

	a. item 12f, enter the total amount of foreign service completed during the period covered by the DD form 214.

	b. item 18, for an active duty Soldier deployed with his or her unit during their continuous period of active service, enter the statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)."

DISCUSSION AND CONCLUSIONS:

1. The applicant's ERB shows in addition to his period of service in Afghanistan that is already shown on his DD Form 214, he also served in Afghanistan from
21 March to 12 July 2010, for a total of 7 months and 23 days of foreign service.

2. Therefore, it would be appropriate at this time to correct his DD Form 214 accordingly.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

___X____ ___X____ ___X____ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

________ ________ ________ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

1. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a. deleting from item 12f of his DD Form 214 the entry "0000 04 01" and replacing it with the entry "0000 07 23" and

	b. adding to item 18 of his DD Form 214 the entry "SERVICE IN AFGHANISTAN FROM 20100321 - 20100712."

2. The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to showing he his total foreign service of 9 months and 2 days.

He provides an ERB, dated 29 January 2013, showing he was deployed to Iraq from 17 December 2010 to 9 March 2011. DFAS records do not show the same period or location of deployed service as that shown on the ERB he provides. He states: * his Combat Infantryman Badge is not listed on his DD Form 214 and Enlisted Record Brief (ERB) * his MOS is supposed to be 11B rather than 11C * his foreign service information is missing from his DD Form 214 3. In the absence of evidence showing he served in MOS 11C, it would be appropriate to amend item 11 of his DD Form 214 to show his primary specialty as 11B1O instead of 11C1O. However, this foreign service is not recorded in item 12f of his DD Form 214.

The evidence of record partially supports the applicant's request for correction of item 12f of his DD Form 214. There is no evidence indicating the applicant was actually deployed to Afghanistan for 9 months. In light of the available evidence, it would be appropriate to correct item 12f of his DD Form 214 to show he had 3 months and 8 days of foreign service.

The applicant provides his DD Form 2900, Enlisted Record Brief (ERB), and DD Form 214. Section I (Assignment Information – OS (Overseas Service)/Deployment Combat Duty) only shows he served in Iraq from 7 May 2009 - 12 April 2010. Additionally, his second period of overseas service is indicated in item 18 of his DD Form 214; however, his first period of foreign service from 3 September to 21 December 2007 is not.
