THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, Board Certification Pay (BCP) for the period 1 January 2010 through 31 December 2012.
2. The applicant states he did not receive entitled BCP from 1 January 2010 through 31 December 2012.
3. The applicant provides:
* Medical Operational Data System Special Pay Record Brief
* Leave and Earnings Statement for the period 1-31 July 2009
* The American Board of Dermatology Certificates
CONSIDERATION OF EVIDENCE:
1. The applicant is currently serving on active duty in the rank/grade of colonel (COL)/O-6 as a Medical Corps officer.
2. During the processing of this case, on 13 May 2013, an advisory opinion was obtained from the Office of The Surgeon General (OTSG). The advisory official stated:
a. A review of supporting documentation and available special pay and finance data indicates the applicant's BCP stopped 31 December 2009 and was
restarted on 1 January 2013, with a current expiration date of 31 December 2019. He did not receive BCP for the period 1 January 2010 through
31 December 2012; however, he was eligible to receive these payments for the
3-year period.
b. The OTSG recommends utilizing a Health Professions Pay Entry Date (HPPED) or finance MS-Pay Date of 15 May 1993 for the correct pay rate level. The retroactive payment for this total period is approximately $18,000.00 prior to taxes. The exact payment will be determined by the Defense Finance and Accounting Service (DFAS).
3. The advisory opinion was forwarded to the applicant for information and to allow him the opportunity to submit comments or a rebuttal. On 22 May 2013, he responded and expressed his agreement with the contents of the advisory opinion.
DISCUSSION AND CONCLUSIONS:
1. The applicant contends, in effect, that his record should be corrected to show authorization/entitlement to receive retroactive payment of BCP for the period
1 January 2010 through 31 December 2012.
2. The advisory opinion rendered by OTSG clearly shows the applicant was fully qualified and eligible for BCP during the period 1 January 2010 through
31 December 2012. Additionally, upon discovery of the error, OTSG records show his BCP was restarted effective 1 January 2013.
3. In view of the foregoing, the applicant should be paid retroactive BCP for the period 1 January 2010 through 31 December 2012.
