THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to reflect his Social Security Number (SSN) as "xxx-xx-xx4x" instead of "xxx-xx-xx1x."

2.  The applicant states a typographical error was made regarding his SSN on his DD Form 214.

3.  The applicant provides a copy of his DD Form 214, Social Security card, and California Commercial Driver License.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.


2.  The applicant enlisted in the Regular Army on 12 September 1969 for a period of 2 years.  He completed training and he was awarded military occupational specialty 71B (clerk-typist).

3.  His record contains the following documents that reflect his SSN as
"xxx-xx-xx4x":

* DD Form 398 (Statement of Personal History), dated 8 September 1969
* Special Orders Number 181, issued by the Armed Forces Examining and Entrance Station, Los Angeles, CA, dated 12 September 1969
* DA Form 428 (Application for Identification Card), dated 20 July 1970

4.  On 10 September 1971, he was honorably released from active duty at the expiration of his term of service (ETS).  He completed 1 year, 11 months, and
29 days of total active service.  His DD Form 214 shows his SSN as
"xxx-xx-xx1x."

5.  Army Regulation 635-5 (Separation Documents) serves as the authority for the preparation of the DD Form 214.  It provides that the DD Form 214 will be prepared to reflect information as it exists in the official records at the time of separation.

DISCUSSION AND CONCLUSIONS:

1.  The applicant enlisted and served with the SSN that is reflected on his Social Security card and other documents contained in his military personnel record.  It appears that during the preparation of his DD Form 214, an administrative error occurred that resulted in a typographical error on his SSN.

2.  In view of the foregoing, the applicant's DD Form 214 should be corrected to reflect the SSN as shown on his Social Security card.

As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by correcting his DD Form 214 to reflect the SSN that is reflected on his Social Security card.
