THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show she entered active duty from St. Louis, Missouri (MO), vice St. Louis, Illinois (IL).

2.  The applicant states the entry in item 7a (Place of Entry into Active Duty) of her DD Form 214 is incorrect.

3.  The applicant provides her DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  The applicant's DD Form 4 (Enlistment/Reenlistment Document – Armed Forces of the United States) shows she enlisted in the U.S. Army Reserve on 17 July 1986 for a period of 8 years and further enlisted in the Regular Army on 24 July 1986 for a period of 3 years.  It also shows in:

* item 3 (Home of Record) – East St. Louis, IL  62204
* item 4 (Place of Enlistment/Reenlistment) – St. Louis Military Entrance Processing Station (MEPS), MO

3.  The applicant's DD Form 214 shows she entered active duty on 24 July 1986 and was honorably discharged on 21 January 2001 based on completion of required active service.  Item 7a shows "ST LOUIS, IL."

4.  Army Regulation 635-5 (Separation Documents) provides instructions for completing separation documents, including the DD Form 214.  The instructions for item 7a state a Soldier's initial enlistment contract or appointment document is the source for this data.  For item 7a, enter the city and state where the Soldier entered active duty.

DISCUSSION AND CONCLUSIONS:

1.  Records show the applicant entered active duty at the MEPS in St. Louis, MO.  Based on the available evidence, it appears that an administrative error was made with respect to the entry for item 7a of her DD Form 214 (i.e., "IL" was erroneously entered as the state instead of "MO").

2.  Therefore, it would be appropriate to correct the applicant's DD Form 214 to show she entered active duty from St. Louis, MO.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting the current entry from item 7a of her DD Form 214 and replacing it with the entry "ST. LOUIS, MO."
