Original file (20130001681.txt) Auto-classification: Denied

		BOARD DATE: 3 September 2013

		DOCKET NUMBER: AR20130001681

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests his date of induction be changed to 19 October 1968.

2. The applicant provides no statements other than the request.

3. The applicant provides a copy of his DD Form 214 (Report of Transfer or Discharge).

CONSIDERATION OF EVIDENCE:

1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2. The applicant's DD Form 47 (Record of Induction) was initiated on
5 November 1968. This form shows the applicant's date of induction and entry onto active duty as 19 November 1968.

3. All documents in the applicant's official record that utilized a date of entry onto active duty shows 19 November 1968.

4. The applicant was honorably released from active duty on 11 September 1970. His DD Form 214 shows he was inducted into the Army of the United States (AUS) on "19 Nov 68." He completed 1 year, 9 months, and 22 days of creditable active service.

5. Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, or release from active duty service or control of the Active Army. It establishes standardized policy for preparing and distributing the DD Form 214 and states the DD Form 214 is a summary of a Soldier's period of continuous active service. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge.

DISCUSSION AND CONCLUSIONS:

The available evidence shows the applicant was inducted into the AUS on
19 November 1968. The applicant has not provided any evidence and the available record does not contain any evidence that shows he was inducted into the Army or served in the Army prior to this date.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

___X___ __X____ ____X____ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case

are insufficient as a basis for correction of the records of the individual concerned.

The applicant requests correction of the social security number (SSN) entered on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). Army Regulation 635-5 (Separation Documents), effective 1 February 1967, stated the SSN in item 3 of the DD Form 214 was to be transcribed from the Soldier's DA Form 2139. DISCUSSION AND CONCLUSIONS: The evidence of record shows the SSN shown on the applicant's social security card was recorded in his record.

His DD Form 214 shows he was REFRAD on 22 August 1973 under the provisions of Army Regulation 635-200 (Personnel Separations), paragraph 5-3 for early release to serve one year in an Army National Guard or U.S. Army Reserve (USAR) unit. All active duty records show the applicant was inducted into the AUS on 13 April 1966 for 2 years. His DD Form 214 shows he was honorably separated on 12 April 1968 with exactly 2 years of service. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. amending item 22a(2) of the applicant’s DD Form 214 to show 10 months and 19 days; and b. amending item 22a(3) of his DD Form 214 to show 2 years, 10 months, and 19 days.

Application for correction of military records (with supporting documents provided, if any). His DD Form 214 shows the following: a. Application for correction of military records (with supporting documents provided, if any). The applicant states that item 17c (Date of Entry) of his DD Form 214 incorrectly shows that he entered active duty on 20 January 1973, and that his military records show that he actually entered active duty on 20 January 1971. The applicant's military records show that he was inducted into the Army of the United States (AUS) on 20 January 1971.

    Original file (20130008801.txt) Auto-classification: Approved

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant states his induction date is one year off. His DD Form 47 shows he was inducted into the AUS on 13 May 1968, and his record contains other allied documents pertaining to his induction that show he was inducted on 13 May 1968.

    Original file (20140004361.txt) Auto-classification: Denied

The applicant does not provide any evidence. There is no evidence in the available records that shows (or fails to show) that he became a U.S. citizen, while still on active duty, or he submitted any personnel actions to change his citizenship status on his military records. Therefore, his DD Form 214 correctly contains the entry "No" to show he was not a U.S. citizen at the time he was released from the military and there is no reason to change the DD Form 214.

Therefore, he is entitled to four bronze service stars for wear on his already-awarded Vietnam Service Medal and correction of his DD Form 214 to show these bronze service stars. The applicant requests correction of the date of birth (DOB) recorded in his military service records. The evidence of record also shows the applicant's DOB was consistently recorded in his official military service records as 12 June 1947 throughout the entire period of his military service (i.e., through 30 November 1996). Thus, there is no basis for granting the applicant's request to change the DOB in his Army records or on his separation documents because his military service records...
