THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 4 September 2010 to show the Meritorious Unit Commendation (MUC).
2. The applicant states:
* he was made aware of the unit award after he retired from active duty
* he was assigned to Company B, Special Troops Battalion, 3rd Brigade Combat Team, 1st Infantry Division while deployed to Afghanistan from
16 September 2008 to 26 June 2009
* the period of service for the MUC is 25 June 2008 to 1 May 2009
3. The applicant provides:
* his Officer Record Brief (ORB), dated 1 July 2010
* Permanent Orders 365-25, issued by the U.S. Army Human Resources Command, dated 31 December 2009
* DD Form 214 for the period ending 4 September 2010
CONSIDERATION OF EVIDENCE:
1. The applicant entered active duty on 7 August 2003. He served in Iraq from 23 February 2005 to 10 January 2006 and in Afghanistan from 16 June 2008 to 25 June 2009. On 4 September 2010, he retired by reason of permanent disability. The DD Form 214 he was issued at the time does not show the MUC as an authorized award.
2. The applicant's record contains Permanent Orders 229-019, issued by Task Force Duke, 3rd Brigade Combat Team, 1st Infantry Division, Forward Operating Bade (FOB) Fenty, Afghanistan, dated 16 August 2008, that awarded him the Combat Action Badge for being engaged by or engaging the enemy in Afghanistan on 7 July 2008.
3. His record also contains a DA Form 67-9 (Officer Evaluation Report (OER) for the period 1 September 2008 through 31 August 2009 that shows he was the company commander assigned to Company B, Special Troops Battalion,
3rd Brigade Combat Team, 1st Infantry Division.
4. He provides Permanent Orders 365-25, dated 31 December 2009, that shows among other units, Company B, Special Troops Battalion, 3rd Brigade Combat Team, 1st Infantry Division was cited for award of the MUC for meritorious service in Afghanistan in support of Operation Enduring Freedom during the period 25 June 2008 to 1 May 2009.
DISCUSSION AND CONCLUSIONS:
The applicant's unit in Afghanistan was cited for award of the MUC during his period of assignment. Therefore, his DD Form 214 should be corrected to show this unit award.
