		IN THE CASE OF:

		BOARD DATE: 22 August 2013

		DOCKET NUMBER: AR20120022643

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1 The applicant requests change of the name on her DD Form 214 (Certificate of Release or Discharge from Active Duty).

2. The applicant states, in effect, she enlisted in Puerto Rico and her own surname incorporated her mother's maiden name.

3. The applicant provides copies of her DD Form 214 and Social Security Card.

CONSIDERATION OF EVIDENCE:

1. The applicant served on active duty in the Regular Army from November 1979 to September 1981.

2. When she enlisted she used the two part surname G____L____. That surname was used throughout her active duty service. Although it was sometimes hyphenated (G____-L____), she always signed it as G____L____.

3. Army Regulation 635-5 (Separation Documents) provides guidance for preparation of the DD Form 214. This regulation has historically stated the DD Form 214 will contain the name taken from the Soldier's personnel record.

DISCUSSION AND CONCLUSIONS:

1. The record shows the applicant enlisted and served under a single, sometimes-hyphenated surname.
2. For historical purposes, the Army has an interest in maintaining the integrity of its records. The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created.

3. The applicant has submitted neither probative evidence nor a convincing argument in support of the request.

BOARD VOTE:
________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

___X____ __X____ ___X____ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

The applicant's request that his 8 June 1953 DD Form 214 be corrected to reflect the current surname which was changed on 17 February 1958 and under which he now goes has been carefully considered. Therefore, the surname listed in the applicant's military records should not be changed at this time.

The applicant requests correction of her records to show her last name as Brxxxxxx-Spxxxxx instead of Spxxxxx on her DD Form 214 (Certificate of Release or Discharge from Active Duty). There is no evidence of record or independent evidence that suggests the last name recorded on the applicant's DD Form 214, dated 13 August 1994, exhibits a material error or injustice. While the applicant provides a court document, filed on 6 December 1999, showing her last name of Spxxxxx was changed to...
