THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


CONSIDERATION OF ADDITIONAL EVIDENCE:

7.  On 30 May 2012, new information was received from the Chief, Army Medical Department (AMEDD) Special Pay Branch, Office of the Surgeon General (OTSG), Falls Church, VA, in regard to the decision of the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20110011396, dated 15 December 2011.

8.  The evidence submitted consists of a corrected advisory opinion from the Chief, AMEDD Special Pay Branch, OTSG.  The OTSG official now states a review of the Board Certification Pay (BCP) entries in finance with the Corrections and Claims Section - Defense Finance and Accounting Service (DFAS), Indianapolis, IN, indicates that there are discrepancies that need to be addressed in the original advisory opinion, dated 13 September 2011, and are revised as below:

	a.  The applicant's Health Professions Pay Entry Date (HPPED) or Finance MS-Pay-Date was incorrect in the initial advisory, but is correct in his military pay account as "19910807."

	b.  Based on the correct HPPED/MS-Pay-Date 19910807, the following periods and BCP rates should be reviewed for compliance and applied for any adjustment or payment:

* 20010807-20030806 at $291.66 per month
* 20030807-20050806 at $333.33 per month
* 
20050807-20090806 at $416.66 per month
* 20090807-indefinite at final rate of $500 per month

	c.  In accordance with Army Regulation 37-104-4 (Military Pay and Allowances Policy), 8 June 2005, chapter 20 - Settlement Actions Resulting from Correction of records by the Army Board for Correction of Military Records (ABCMR) , only the Director - DFAS may make settlement actions affecting the military pay account of Soldiers as a result of correction of records by the ABCMR.  

ADDITIONAL DISCUSSION AND CONCLUSIONS:

4.  At the time of the decision of the ABCMR in Docket Number AR20110011396, dated 15 December 2011, it was the intent of the ABCMR to make the applicant’s record as administratively correct as it should properly have been at the time.

5.  The ABCMR's decision in Docket Number AR20110011396 determined that according to the OTSG database, the applicant was board certified on 1 February 2001 and has been receiving the correct BCP.  However, based on the applicant's request, finance data, and the supporting documentation, OTSG officials determined the applicant started receiving BCP on 17 July 2008.  OTSG officials also determined the applicant did not receive BCP from 6 June 2007 to 16 July 2008.  The official recommended the applicant receive BCP in arrears for the period 6 June 2007 to 16 July 2008 utilizing an HPPED or MS pay date of 1 July 2002 for the correct pay rate level.

3.  The Board determined that the evidence presented was sufficient to warrant amendment of the decision of the ABCMR set forth in Docket Number AR20110011396, dated 15 December 2011 to show the following periods and 

BCP rates should be reviewed for compliance and applied for any adjustment or payment using an HPPED of 7 August 1991:

* 20010807-20030806 at $291.66 per month
* 20030807-20050806 at $333.33 per month
* 20050807-20090806 at $416.66 per month
* 20090807-indefinite at final rate of $500 per month
