THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of block 18 (Remarks) of her DD Form 214 (Certificate of Release or Discharge from Active Duty) by amending her dates of service in Iraq.
2. The applicant states the dates in block 18 which show her service in Iraq from 4 April 2009 through 15 June 2010 should match block 12a (Date Entered Active Duty) and 12b (Separation Date this Period). She believes the error was due to the quick processing when she arrived back in the United States.
3. The applicant provides a copy of her DD Form 214.
CONSIDERATION OF EVIDENCE:
1. The applicant, a U.S. Army Reserve (USAR) Soldier, completed initial active duty for training (IADT) in 1999. She served on active duty from December 2003 through February 2005 including service in Iraq.
2. She was ordered to active duty in 2009, again served in Iraq, and was released from active duty in 2010.
3. Block 12a of her DD Form 214 shows she entered active duty on 25 June 2009. Block 12b shows she was released from active duty on 5 August 1010. Block 18 states she served in Iraq from 4 April 2009 through 15 June 2010.
4. Her master military pay account (MMPA) shows:
* she entered active duty on 25 June 2009 and was released from active duty on 5 August 1010
* she received hostile fire/imminent danger pay from 1 October 2009 through 29 July 2010
DISCUSSION AND CONCLUSIONS:
1. The applicant states the deployment dates shown in block 18 should match the entry and separation dates shown in blocks 12a and 12b (20090625 to 20100805).
2. According to her MMPA the dates in block 18 are incorrect and should be changed to match the dates for which she received fire/imminent danger pay.
3. However, logic would indicate she could not possibly have served in Iraq every single day she was on active duty and, indeed, her MMPA shows she did not. Therefore, there is no basis for granting the applicant's request to make those dates match.

BOARD DETERMINATION/RECOMMENDATION:
1. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by correcting block 18 of her 5 August 2010 DD Form 214 by:
a. deleting "Service in Iraq 20090405 to 20100615"; and
b. inserting "Service in Iraq 20091001 to 20100729."
2. The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to showing in block 18 that she served in Iraq from 20090625 to 20100805.

He further states he was deployed to Iraq from August to December 2008 but item 12f of his DD Form 214 does not show his foreign service nor does his DD Form 214 show the actual dates he served in Iraq. Evidence of record shows the applicant entered active duty on 27 August 2007 and was discharged on 14 July 2009 which is 1 year, 10 months, and 18 days. However, evidence of record shows the applicant had 90 days lost time under Title 10 USC 972 from 15 April 2009 to 14 July 2009.

He states he only served in Iraq although his DD Form 214 shows he served in Afghanistan. Soldiers who serve 11 cumulative months in a 24-month period or 9 continuous months in Iraq or Afghanistan receive credit for a completed short tour (rules 6 and 8 of Table 3-2, Army Regulation 614-30 (Overseas Service), apply). The total amount of foreign service completed during the Soldier's continuous period of active service will be entered as "YYYY MM DD" in block 12f.

The evidence of record shows that after completing 5 months and 28 days in the DEP, the applicant enlisted in the Regular Army and entered active duty on 3 August 2005. Therefore, there is sufficient evidence to correct his records to show his 1 year, 2 months, and 24 days of service in Kuwait/Iraq as 15 August 2006 to 7 November 2007 and to show this period of service in Iraq as his correct period of foreign service.
