THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, correction of his DD Form 214 for the period ending 31 December 2009 to show the Iraq Campaign Medal (ICM) with three bronze service stars instead of the ICM with two bronze service stars.
2. The applicant states:
* He served in Iraq from 18 June 2004 to 20 June 2005
* He participated in three campaigns (Transition of Iraq, Iraqi Governance, and National Resolution) in Iraq
3. The applicant provides:
* Department of Defense news release pertaining to additional phases identified for the ICM
* DD Forms 214 (Certificate of Release or Discharge from Active Duty) for the periods ending 31 October 2005, 30 September 2007, and
31 December 2009
* DD Form 215 (Correction to DD Form 214), dated 7 September 2010
CONSIDERATION OF EVIDENCE:
1. Having prior service in the Army National Guard (ARNG), the applicant enlisted in the Regular Army on 29 August 1997. He served as an infantryman in
Kuwait/Iraq from 18 June 2004 to 20 June 2005. On 31 October 2005, he was honorably discharged at the completion of required active service. The DD Form 214 he was issued at the time shows he served in Kuwait/Iraq from 18 June 2004 to 20 June 2005.
2. He enlisted in the New York ARNG (NYARNG) on 1 November 2005. On
20 February 2007, he was ordered to active for training (ADT). On
30 September 2007, he was honorably released from active duty at the completion of his period of ADT. He was transferred back to his NYARNG unit.
3. On 8 September 2009, he was ordered to active duty from the NYARNG. On
31 December 2009, he was honorably released from active duty at the completion of his active duty period. DD Form 214 he was issued at the time shows, among other awards, the ICM with two bronze service stars.
4. There is no evidence the applicant served in Iraq during any other period than from 18 June 2004 to 20 June 2005.
5. He was honorably discharged from the NYARNG on 13 June 2011.
6. Army Regulation 600-8-22 (Military Awards) states the ICM is awarded to members who served in direct support of Operation Iraqi Freedom. The area of eligibility encompasses all the land area of the country of Iraq, the contiguous water area out to 12 nautical miles, and all air spaces above the land area of Iraq and above the contiguous water area out to 12 nautical miles. The ICM period of eligibility is on or after 19 March 2003 to 31 December 2011. A bronze service star is authorized for wear with this medal for participation in each credited campaign. Approved campaigns are:
* Liberation of Iraq (19 March 2003 - 1 May 2003)
* Transition of Iraq (2 May 2003 - 28 June 2004)
* Iraqi Governance (29 June 2004 - 15 December 2005)
* National Resolution (16 December 2005 - 9 January 2007)
* Iraqi Surge (10 January 2007 - 31 December 2008)
* Iraqi Sovereignty (1 January 2009 - 31 August 2010)
* New Dawn (1 September 2010 - 31 December 2011)
DISCUSSION AND CONCLUSIONS:
1. The applicant contends he served in Iraq from 18 June 2004 to 20 June 2005 and participated in three campaigns (Transition of Iraq, Iraqi Governance, and National Resolution).
2. Evidence of record shows the applicant served in Iraq from 18 June 2004 to 20 June 2005. The period encompasses two designated campaigns: the Transition of Iraq (2 May 2003 - 28 June 2004) and the Iraqi Governance (29 June 2004 - 15 December 2005). As such, he is entitled to two bronze service stars for wear on his already-awarded ICM which are properly shown on his DD Form 214 for the period ending 31 December 2009.
3. In view of the foregoing, there is no basis for granting the applicant's requested relief.
